| 7 | 7 | | relating to dedication of a portion of unclaimed lottery revenues |

| 8 | 8 | | to the Texas rail relocation and improvement fund. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 466.408(b), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) If a claim is not made for prize money on or before the |
|---|
| 13 | 13 | | 180th day after the date on which the winner was selected, the prize |
|---|
| 14 | 14 | | money shall be used in the following order of priority: |
|---|
| 15 | 15 | | (1) subject to legislative appropriation, not more |
|---|
| 16 | 16 | | than $20 million in prize money each year may be deposited to or |
|---|
| 17 | 17 | | appropriated from the [Texas] Department of State Health Services |
|---|
| 18 | 18 | | state-owned multicategorical teaching hospital account, which is |
|---|
| 19 | 19 | | an account in the general revenue fund; |
|---|
| 20 | 20 | | (2) not more than $5 million in prize money each year |
|---|
| 21 | 21 | | may be appropriated to the Health and Human Services Commission and |
|---|
| 22 | 22 | | shall be used to support the provision of inpatient hospital |
|---|
| 23 | 23 | | services in hospitals located in the 15 counties that comprise the |
|---|
| 24 | 24 | | Texas-Mexico border area, with payment for those services to be not |
|---|
| 25 | 25 | | less than the amount established under the Tax Equity and Fiscal |
|---|
| 26 | 26 | | Responsibility Act of 1982 (TEFRA) cost reimbursement methodology |
|---|
| 27 | 27 | | for the hospital providing the services; and |
|---|
| 28 | 28 | | (3) all prize money subject to this section and not |
|---|
| 29 | 29 | | appropriated in accordance with [from the Texas Department of |
|---|
| 30 | 30 | | Health state-owned multicategorical teaching hospital account or |
|---|
| 31 | 31 | | not appropriated to the Health and Human Services Commission for |
|---|
| 32 | 32 | | the purpose specified in] Subdivision (1) or (2) shall be deposited |
|---|
| 33 | 33 | | in the Texas rail relocation and improvement fund created under |
|---|
| 34 | 34 | | Section 49-o, Article III, Texas Constitution, and may be used only |
|---|
| 35 | 35 | | as provided by that section [general revenue fund and may be |
|---|
| 36 | 36 | | appropriated for any purpose as determined by the legislature, |
|---|
| 37 | 37 | | including the provision of indigent health care services as |
|---|
| 38 | 38 | | specified in Chapter 61, Health and Safety Code]. |

| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2009. |
