66 AN ACT
77 relating to dedication of a portion of unclaimed lottery revenues
88 to the Texas rail relocation and improvement fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 466.408(b), Government Code, is amended
1111 to read as follows:
1212 (b) If a claim is not made for prize money on or before the
1313 180th day after the date on which the winner was selected, the prize
1414 money shall be used in the following order of priority:
1515 (1) subject to legislative appropriation, not more
1616 than $20 million in prize money each year may be deposited to or
1717 appropriated from the [Texas] Department of State Health Services
1818 state-owned multicategorical teaching hospital account, which is
1919 an account in the general revenue fund;
2020 (2) not more than $5 million in prize money each year
2121 may be appropriated to the Health and Human Services Commission and
2222 shall be used to support the provision of inpatient hospital
2323 services in hospitals located in the 15 counties that comprise the
2424 Texas-Mexico border area, with payment for those services to be not
2525 less than the amount established under the Tax Equity and Fiscal
2626 Responsibility Act of 1982 (TEFRA) cost reimbursement methodology
2727 for the hospital providing the services; and
2828 (3) all prize money subject to this section and not
2929 appropriated in accordance with [from the Texas Department of
3030 Health state-owned multicategorical teaching hospital account or
3131 not appropriated to the Health and Human Services Commission for
3232 the purpose specified in] Subdivision (1) or (2) shall be deposited
3333 in the Texas rail relocation and improvement fund created under
3434 Section 49-o, Article III, Texas Constitution, and may be used only
3535 as provided by that section [general revenue fund and may be
3636 appropriated for any purpose as determined by the legislature,
3737 including the provision of indigent health care services as
3838 specified in Chapter 61, Health and Safety Code].
3939 SECTION 2. This Act takes effect September 1, 2009.
