5	5	relating to the transfer of certain state property from the Texas
6	6	Department of Criminal Justice to Mitchell County.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. (a) Not later than the 30th day after the
9	9	effective date of this Act, the Texas Department of Criminal
10	10	Justice shall transfer to Mitchell County the real property
11	11	described by Subsection (e) of this section.
12	12	(b) Mitchell County shall use the property transferred
13	13	under this Act only for a purpose that benefits the public interest
14	14	of the state. If Mitchell County uses the property for any purpose
15	15	other than a purpose that benefits the public interest of the state,
16	16	ownership of the property automatically reverts to the Texas
17	17	Department of Criminal Justice.
18	18	(c) The Texas Department of Criminal Justice shall transfer
19	19	the property by an appropriate instrument of transfer. The
20	20	instrument of transfer must:
21	21	(1) provide that:
22	22	(A) Mitchell County use the property only for a
23	23	purpose that benefits the public interest of the state; and
24	24	(B) ownership of the property will automatically
25	25	revert to the Texas Department of Criminal Justice if Mitchell
26	26	County uses the property for any purpose other than a purpose that
27	27	benefits the public interest of the state; and
28	28	(2) describe the property to be transferred by metes
29	29	and bounds.
30	30	(d) The Texas Department of Criminal Justice shall retain
31	31	custody of the instrument of transfer after the instrument of
32	32	transfer is filed in the real property records of Mitchell County.
33	33	(e) The real property referred to in this section is
34	34	described as follows:
35	35	Tract 1
36	36	221.72 acres of land out of Section 31, Block 26, T&P Rwy. Co
37	37	Surveys, Mitchell County, Texas, and being the middle 1/2 of that
38	38	portion of said Section 31 north of Interstate 20. Described
39	39	further by metes and bounds as follows:
40	40	Beginning: At an iron pin in the north line of said section
41	41	that is N 76 38' 11" E - 1184.8' from the N.W. corner of said Section

43	43	Thence: N 76 38' 11" E - 2550.8' along said north line to an
44	44	iron pin
45	45	Thence: S 12 51' 41" E - 3325.7' to an iron pin in the north
46	46	r/w of Interstate 20
47	47	Thence: S 56 49' 49" W - 2719.9' along said r/w to an iron pin
48	48	Thence: N 12 51' 41" W - 4247.3' to the place of beginning and
49	49	containing 221.72 acres of land more or less.
50	50	(f) Mitchell County shall pay any transaction fees
51	51	resulting from the transfer of property under this Act.
52	52	SECTION 2. This Act takes effect immediately if it receives
53	53	a vote of two-thirds of all the members elected to each house, as
54	54	provided by Section 39, Article III, Texas Constitution. If this
55	55	Act does not receive the vote necessary for immediate effect, this
56	56	Act takes effect September 1, 2009.
