| 6 | 6 | | borders for issuing certain utility certificates. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subsection (g), Section 232.028, Local |
|---|
| 9 | 9 | | Government Code, is amended to read as follows: |
|---|
| 10 | 10 | | (g) The commissioners court may impose a fee for a |
|---|
| 11 | 11 | | certificate issued under this section for a subdivision [part of] |
|---|
| 12 | 12 | | which is located in the county and not within the limits [the |
|---|
| 13 | 13 | | extraterritorial jurisdiction] of a municipality [and part of which |
|---|
| 14 | 14 | | is not located in the extraterritorial jurisdiction of the |
|---|
| 15 | 15 | | municipality]. The amount of the fee may be the greater of $30 or |
|---|
| 16 | 16 | | the amount of the fee imposed by the municipality for a subdivision |
|---|
| 17 | 17 | | that is located entirely in the extraterritorial jurisdiction of |
|---|
| 18 | 18 | | the municipality for a certificate issued under Section 212.0115. |
|---|
| 19 | 19 | | A person who obtains a certificate under this section is not |
|---|
| 20 | 20 | | required to obtain a certificate under Section 212.0115. |

| 21 | 21 | | SECTION 2. Section 232.029, Local Government Code, is |
|---|
| 22 | 22 | | amended by adding Subsection (n) to read as follows: |
|---|
| 23 | 23 | | (n) The commissioners court may impose a fee for a |

|---|
