66 AN ACT
77 relating to voter approval for certain contracts between political
88 subdivisions and private entities relating to correctional
99 facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 303, Local Government
1212 Code, is amended by adding Section 303.0711 to read as follows:
1313 Sec. 303.0711. BONDS FOR CORRECTIONAL FACILITIES. (a) In
1414 this section, "correctional facility" means a facility for the
1515 confinement of a person arrested for, charged with, or convicted of
1616 a criminal offense.
1717 (b) A corporation may issue or incur bonds under this
1818 subchapter to finance, refinance, or provide a correctional
1919 facility to be constructed, leased, operated, purchased,
2020 maintained, or managed under a contract with a private entity only
2121 if the issuance of the bonds is approved by a majority of the voters
2222 of the sponsor voting in an election ordered for that purpose.
2323 SECTION 2. Section 351.101, Local Government Code, is
2424 amended to read as follows:
2525 Sec. 351.101. AUTHORITY TO CONTRACT. (a) The
2626 commissioners court of a county, with the approval of the sheriff of
2727 the county, may contract with a private organization to place
2828 inmates in a detention facility operated by the organization only
2929 if a majority of the voters of the county approve the contract at an
3030 election ordered by the commissioners court for that purpose.
3131 (b) The commissioners court may not contract with a private
3232 organization in which a member of the court or an elected or
3333 appointed peace officer who serves in the county has a financial
3434 interest or in which an employee or commissioner of the Commission
3535 on Jail Standards has a financial interest.
3636 (c) A contract made in violation of this section is void.
3737 SECTION 3. Section 351.102, Local Government Code, is
3838 amended to read as follows:
3939 Sec. 351.102. ADDITIONAL AUTHORITY TO CONTRACT. (a) The
4040 commissioners court of a county may contract with a private vendor
4141 to provide for the financing, design, construction, leasing,
4242 operation, purchase, maintenance, or management of a jail,
4343 detention center, work camp, or related facility.
4444 (b) The commissioners court may not award a contract under
4545 this section unless:
4646 (1) a majority of the voters of the county approve the
4747 contract at an election ordered by the commissioners court for that
4848 purpose;
4949 (2) the commissioners court requests proposals by
5050 public notice and not less than 30 days from such notice receives a
5151 proposal that meets or exceeds the requirements specified in the
5252 request for proposals; and
5353 (3) [. Before the commissioners court of a county
5454 enters into a contract under this section,] the commissioners court
5555 of the county:
5656 (A) receives [must receive] the written approval
5757 of the sheriff of the county, which written approval shall not be
5858 unreasonably withheld; [,] or
5959 (B) if the county has a population of 2.8 million
6060 or more:
6161 (i) ensures [(1) ensure] that all services
6262 provided under the contract are required to meet or exceed
6363 standards set by the Commission on Jail Standards; or
6464 (ii) receives [(2) receive] the written
6565 approval of the sheriff of the county, which written approval shall
6666 not be unreasonably withheld.
6767 SECTION 4. Section 361.061, Local Government Code, is
6868 amended to read as follows:
6969 Sec. 361.061. AUTHORITY TO CONTRACT. The governing body of
7070 a municipality may contract with a private vendor or a county to
7171 provide for the financing, design, construction, leasing,
7272 operation, purchase, maintenance, or management of a jail,
7373 detention center, work camp, or related facility. Before the
7474 governing body of a municipality may enter into a contract with a
7575 private vendor under this section, the majority of the voters of the
7676 municipality must approve the contract at an election ordered by
7777 the governing body for that purpose.
7878 SECTION 5. The changes in law made by this Act apply only to
7979 bonds issued or contracts entered into on or after the effective
8080 date of this Act. Bonds issued or contracts entered into before the
8181 effective date of this Act are governed by the law in effect when
8282 the bonds were issued or the contracts were entered into, and the
8383 former law is continued in effect for that purpose.
8484 SECTION 6. This Act takes effect September 1, 2009.
