55 AN ACT
66 relating to the use of state hotel occupancy tax revenue to clean
77 and maintain beaches in certain municipalities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subdivision (1), Subsection (c), Section
1010 156.2512, Tax Code, is amended to read as follows:
1111 (1) "Eligible barrier island coastal municipality"
1212 means a municipality:
1313 (A) that borders on the Gulf of Mexico;
1414 (B) that is located wholly or partly on a barrier
1515 island; and
1616 (C) the boundaries of which are within 30 miles
1717 of the United Mexican States or include:
1818 (i) a portion of a national seashore; or
1919 (ii) a national estuarine research reserve.
2020 SECTION 2. This Act takes effect on the first day of the
2121 first month beginning on or after the earliest date on which this
2222 Act may take effect if it receives a vote of two-thirds of all the
2323 members elected to each house, as provided by Section 39, Article
2424 III, Texas Constitution. If this Act does not receive the vote
2525 necessary for effect on that date, this Act takes effect September
2626 1, 2009.
