| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 511.0094, Government Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | Sec. 511.0094. EXCLUSION OF JAILS OR CORRECTIONAL | |
| 13 | 13 | FACILITIES HOUSING ONLY FEDERAL PRISONERS. The provisions of this | |
| 14 | 14 | chapter do not apply to a correctional facility, other than a | |
| 15 | 15 | county-owned facility, contracting to house only federal prisoners | |
| 16 | 16 | and operating pursuant to a contract between a unit of the federal | |
| 17 | 17 | government and a county, a municipality, or a private vendor. If a | |
| 18 | 18 | county, municipality, or private vendor contracts to house or | |
| 19 | 19 | begins to house state, county, or municipal prisoners or prisoners | |
| 20 | 20 | of another state of the United States, it shall report to the | |
| 21 | 21 | commission before placing such inmates in a correctional facility | |
| 22 | 22 | housing only federal prisoners. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2009. |
