55 AN ACT
66 relating to the confidentiality of certain personal information
77 concerning current and former employees of certain divisions of the
88 office of the attorney general.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Section 552.117, Government
1111 Code, is amended to read as follows:
1212 (a) Information is excepted from the requirements
1313 of Section 552.021 if it is information that relates to the home
1414 address, home telephone number, or social security number of the
1515 following person or that reveals whether the person has family
1616 members:
1717 (1) a current or former official or employee of a
1818 governmental body, except as otherwise provided by Section 552.024;
1919 (2) a peace officer as defined by Article 2.12, Code of
2020 Criminal Procedure, or a security officer commissioned under
2121 Section 51.212, Education Code, regardless of whether the officer
2222 complies with Section 552.024 or 552.1175, as applicable;
2323 (3) a current or former employee of the Texas
2424 Department of Criminal Justice or of the predecessor in function of
2525 the department or any division of the department, regardless of
2626 whether the current or former employee complies with Section
2727 552.1175;
2828 (4) a peace officer as defined by Article 2.12, Code of
2929 Criminal Procedure, or other law, a reserve law enforcement
3030 officer, a commissioned deputy game warden, or a corrections
3131 officer in a municipal, county, or state penal institution in this
3232 state who was killed in the line of duty, regardless of whether the
3333 deceased complied with Section 552.024 or 552.1175;
3434 (5) a commissioned security officer as defined by
3535 Section 1702.002, Occupations Code, regardless of whether the
3636 officer complies with Section 552.024 or 552.1175, as applicable;
3737 [or]
3838 (6) an officer or employee of a community supervision
3939 and corrections department established under Chapter 76 who
4040 performs a duty described by Section 76.004(b), regardless of
4141 whether the officer or employee complies with Section 552.024 or
4242 552.1175; or
4343 (7) a current or former employee of the office of the
4444 attorney general who is or was assigned to a division of that office
4545 the duties of which involve law enforcement, regardless of whether
4646 the current or former employee complies with Section 552.024 or
4747 552.1175.
4848 SECTION 2. Subsection (a), Section 552.1175, Government
4949 Code, is amended to read as follows:
5050 (a) This section applies only to:
5151 (1) peace officers as defined by Article 2.12, Code of
5252 Criminal Procedure;
5353 (2) county jailers as defined by Section 1701.001,
5454 Occupations Code;
5555 (3) current or former employees of the Texas
5656 Department of Criminal Justice or of the predecessor in function of
5757 the department or any division of the department;
5858 (4) commissioned security officers as defined by
5959 Section 1702.002, Occupations Code;
6060 (5) employees of a district attorney, criminal
6161 district attorney, or county or municipal attorney whose
6262 jurisdiction includes any criminal law or child protective services
6363 matters; [and]
6464 (6) officers and employees of a community supervision
6565 and corrections department established under Chapter 76 who perform
6666 a duty described by Section 76.004(b); and
6767 (7) current and former employees of the office of the
6868 attorney general who are or were assigned to a division of that
6969 office the duties of which involve law enforcement.
7070 SECTION 3. Subsection (a), Section 25.025, Tax Code, as
7171 amended by Chapters 594 (H.B. 41), 621 (H.B. 455), and 851 (H.B.
7272 1141), Acts of the 80th Legislature, Regular Session, 2007, is
7373 reenacted and amended to read as follows:
7474 (a) This section applies only to:
7575 (1) a current or former peace officer as defined by
7676 Article 2.12, Code of Criminal Procedure;
7777 (2) a county jailer as defined by Section 1701.001,
7878 Occupations Code;
7979 (3) an employee of the Texas Department of Criminal
8080 Justice;
8181 (4) a commissioned security officer as defined by
8282 Section 1702.002, Occupations Code;
8383 (5) a victim of family violence as defined by Section
8484 71.004, Family Code, if as a result of the act of family violence
8585 against the victim, the actor is convicted of a felony or a Class A
8686 misdemeanor; [and]
8787 (6) a federal judge or state judge;
8888 (7) [(6)] a current or former employee of a district
8989 attorney, criminal district attorney, or county or municipal
9090 attorney whose jurisdiction includes any criminal law or child
9191 protective services matters;
9292 (8) [(6)] an officer or employee of a community
9393 supervision and corrections department established under Chapter
9494 76, Government Code, who performs a duty described by Section
9595 76.004(b) of that code; and
9696 (9) a current or former employee of the office of the
9797 attorney general who is or was assigned to a division of that office
9898 the duties of which involve law enforcement.
9999 SECTION 4. This Act takes effect immediately if it receives
100100 a vote of two-thirds of all the members elected to each house, as
101101 provided by Section 39, Article III, Texas Constitution. If this
102102 Act does not receive the vote necessary for immediate effect, this
103103 Act takes effect September 1, 2009.
