| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 33.093 to read as follows: |
|---|
| 12 | 12 | | Sec. 33.093. PHYSICAL EXAMINATION REQUIRED FOR |
|---|
| 13 | 13 | | PARTICIPATION IN EXTRACURRICULAR ATHLETIC ACTIVITY. (a) In this |
|---|
| 14 | 14 | | section: |
|---|
| 15 | 15 | | (1) "Advanced practice nurse" means a registered nurse |
|---|
| 16 | 16 | | approved by the Texas Board of Nursing to practice as an advanced |
|---|
| 17 | 17 | | practice nurse as provided by Section 301.152, Occupations Code. |
|---|
| 18 | 18 | | (2) "Physician" means a physician licensed under |
|---|
| 19 | 19 | | Subtitle B, Title 3, Occupations Code. |
|---|
| 20 | 20 | | (3) "Physician assistant" means a person who is |
|---|
| 21 | 21 | | licensed under Chapter 204, Occupations Code. |
|---|
| 22 | 22 | | (b) A student may not participate in an extracurricular |
|---|
| 23 | 23 | | athletic activity, including an athletic practice, scrimmage, |
|---|
| 24 | 24 | | game, or match, sponsored or sanctioned by the University |
|---|
| 25 | 25 | | Interscholastic League unless the student has submitted to the |
|---|
| 26 | 26 | | school district the student attends a completed form indicating |
|---|
| 27 | 27 | | that the student has received a physical examination conducted by a |
|---|
| 28 | 28 | | physician, physician assistant, or advanced practice nurse. The |
|---|
| 29 | 29 | | form must: |
|---|
| 30 | 30 | | (1) be signed by the physician, physician assistant, |
|---|
| 31 | 31 | | or advanced practice nurse; and |
|---|
| 32 | 32 | | (2) include a statement that, based on the |
|---|
| 33 | 33 | | examination, the physician, physician assistant, or advanced |
|---|
| 34 | 34 | | practice nurse has determined that the student does not have a |
|---|
| 35 | 35 | | medical condition that would make participation in the athletic |
|---|
| 36 | 36 | | activity hazardous for the student. |
|---|
| 37 | 37 | | (c) The University Interscholastic League shall adopt rules |
|---|
| 38 | 38 | | to administer this section. |
|---|
| 39 | 39 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 40 | 40 | | school year. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2009. |
