66 AN ACT
77 relating to physical examination requirements for participation in
88 extracurricular athletic activities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1111 amended by adding Section 33.093 to read as follows:
1212 Sec. 33.093. PHYSICAL EXAMINATION REQUIRED FOR
1313 PARTICIPATION IN EXTRACURRICULAR ATHLETIC ACTIVITY. (a) In this
1414 section:
1515 (1) "Advanced practice nurse" means a registered nurse
1616 approved by the Texas Board of Nursing to practice as an advanced
1717 practice nurse as provided by Section 301.152, Occupations Code.
1818 (2) "Physician" means a physician licensed under
1919 Subtitle B, Title 3, Occupations Code.
2020 (3) "Physician assistant" means a person who is
2121 licensed under Chapter 204, Occupations Code.
2222 (b) A student may not participate in an extracurricular
2323 athletic activity, including an athletic practice, scrimmage,
2424 game, or match, sponsored or sanctioned by the University
2525 Interscholastic League unless the student has submitted to the
2626 school district the student attends a completed form indicating
2727 that the student has received a physical examination conducted by a
2828 physician, physician assistant, or advanced practice nurse. The
2929 form must:
3030 (1) be signed by the physician, physician assistant,
3131 or advanced practice nurse; and
3232 (2) include a statement that, based on the
3333 examination, the physician, physician assistant, or advanced
3434 practice nurse has determined that the student does not have a
3535 medical condition that would make participation in the athletic
3636 activity hazardous for the student.
3737 (c) The University Interscholastic League shall adopt rules
3838 to administer this section.
3939 SECTION 2. This Act applies beginning with the 2009-2010
4040 school year.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
