66 relating to newborn screening and the creation of the Newborn
77 Screening Advisory Committee.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act may be cited as "Greyson's Law" in
1010 memory of Greyson Morris.
1111 SECTION 2. Subsection (a-1), Section 33.011, Health and
1212 Safety Code, is amended to read as follows:
1313 (a-1) Except as provided by this subsection and to [To] the
1414 extent funding is available for the screening, the department shall
1515 require newborn screening tests to screen for disorders listed in
1616 the core [uniform] panel and in the secondary targets of the uniform
1717 newborn screening panel [conditions] recommended in the 2005 report
1818 by the American College of Medical Genetics entitled "Newborn
1919 Screening: Toward a Uniform Screening Panel and System" or another
2020 report determined by the department to provide more stringent
2121 [appropriate] newborn screening guidelines to protect the health
2222 and welfare of this state's newborns. The department, with the
2323 advice of the Newborn Screening Advisory Committee, may require
2424 additional newborn screening tests under this subsection to screen
2525 for other disorders or conditions. The department may exclude from
2626 the newborn screening tests required under this subsection
2727 screenings for galactose epimerase and galactokinase.
2828 SECTION 3. Subchapter B, Chapter 33, Health and Safety
2929 Code, is amended by adding Section 33.017 to read as follows:
3030 Sec. 33.017. NEWBORN SCREENING ADVISORY COMMITTEE.
3131 (a) The department shall establish the Newborn Screening Advisory
3232 Committee.
3333 (b) The advisory committee consists of members appointed by
3434 the commissioner of state health services. The advisory committee
3535 must include the following members:
3636 (1) health care providers;
3737 (2) a hospital representative;
3838 (3) persons who have family members affected by a
3939 condition for which newborn screening is or may be required under
4040 this subchapter; and
4141 (4) persons who are involved in the delivery of
4242 newborn screening services, follow-up, or treatment in this state.
4343 (c) The advisory committee shall advise the department
4444 regarding strategic planning, policy, rules, and services related
4545 to newborn screening and additional newborn screening tests.
4646 (d) The advisory committee shall adopt bylaws governing the
4747 committee's operations.
4848 (e) The advisory committee may appoint subcommittees.
4949 (f) The advisory committee shall meet at least three times
5050 each year and at other times at the call of the commissioner of
5151 state health services.
5252 (g) A member of the advisory committee is not entitled to
5353 compensation, but is entitled to reimbursement for travel or other
5454 expenses incurred by the member while conducting the business of
5555 the advisory committee, as provided by the General Appropriations
5656 Act.
5757 (h) The advisory committee is not subject to Chapter 2110,
5858 Government Code.
5959 SECTION 4. (a) As soon as practicable after the effective
6060 date of this Act, the commissioner of state health services shall
6161 appoint members to the Newborn Screening Advisory Committee as
6262 required under Section 33.017, Health and Safety Code, as added by
6363 this Act.
6464 (b) Notwithstanding Section 33.011, Health and Safety Code,
6565 as amended by this Act, a physician or person attending the delivery
6666 of a newborn child is not required to subject the child to the
6767 additional newborn screening tests required under Subsection
6868 (a-1), Section 33.011, Health and Safety Code, as amended by this
6969 Act, until January 1, 2010.
7070 SECTION 5. This Act does not make an appropriation. A
7171 provision in this Act that creates a new governmental program,
7272 creates a new entitlement, or imposes a new duty on a governmental
7373 entity is not mandatory during a fiscal period for which the
7474 legislature has not made a specific appropriation to implement the
7575 provision.
7676 SECTION 6. This Act takes effect September 1, 2009.
