5	5	relating to an informational manual for voluntary caregivers who
6	6	provide temporary care for children who are the subject of an
7	7	investigation by the Department of Family and Protective Services.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 261.3071, Family Code, is amended to
10	10	read as follows:
11	11	Sec. 261.3071. INFORMATIONAL MANUALS. (a) In this
12	12	section:
13	13	(1) "Designated caregiver" and[,] "relative
14	14	caregiver" [and "designated caregiver"] have the meanings assigned
15	15	those terms by Section 264.751.
16	16	(2) "Voluntary caregiver" means a person who
17	17	voluntarily agrees to provide temporary care for a child:
18	18	(A) who is the subject of an investigation by the
19	19	department or whose parent, managing conservator, possessory
20	20	conservator, guardian, caretaker, or custodian is receiving
21	21	family-based safety services from the department;
22	22	(B) who is not in the conservatorship of the
23	23	department; and
24	24	(C) who is placed in the care of the person by the
25	25	parent or other person having legal custody of the child.
26	26	(b) The department shall develop and publish informational
27	27	manuals that provide information for:
28	28	(1) a parent or other person having custody of a child
29	29	who is the subject of an investigation under this chapter; [and]
30	30	(2) a person who is selected by the department to be
31	31	the child's relative or designated caregiver; and
32	32	(3) a voluntary caregiver.
33	33	(c) Information provided in the manuals must be in both
34	34	English and Spanish and must include, as appropriate:
35	35	(1) useful indexes of information such as telephone
36	36	numbers;
37	37	(2) the information required to be provided under
38	38	Section 261.307(a)(1);
39	39	(3) information describing the rights and duties of a
40	40	relative or designated caregiver; [and]
41	41	(4) information regarding the relative and other
42	42	designated caregiver program under Subchapter I, Chapter 264; and
43	43	(5) information regarding the role of a voluntary
44	44	caregiver, including information on how to obtain any documentation
45	45	necessary to provide for a child's needs.
46	46	SECTION 2. This Act takes effect immediately if it receives
47	47	a vote of two-thirds of all the members elected to each house, as
48	48	provided by Section 39, Article III, Texas Constitution. If this
49	49	Act does not receive the vote necessary for immediate effect, this
50	50	Act takes effect September 1, 2009.
