| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter D, Chapter 341, Health and Safety |
|---|
| 9 | 9 | | Code, is amended by adding Section 341.0645 to read as follows: |
|---|
| 10 | 10 | | Sec. 341.0645. POOL SAFETY. (a) An owner, manager, |
|---|
| 11 | 11 | | operator, or other attendant in charge of a public swimming pool, |
|---|
| 12 | 12 | | wading pool, baby pool, hot tub, in-ground spa, water park, spray |
|---|
| 13 | 13 | | fountain, or other artificial body of water typically used for |
|---|
| 14 | 14 | | recreational swimming, bathing, or play shall comply with pool |
|---|
| 15 | 15 | | safety standards adopted under this section. |
|---|
| 16 | 16 | | (b) The executive commissioner of the Health and Human |
|---|
| 17 | 17 | | Services Commission shall adopt by rule pool safety standards |
|---|
| 18 | 18 | | necessary to prevent drowning. The standards must be at least as |
|---|
| 19 | 19 | | stringent as those imposed under the federal Virginia Graeme Baker |
|---|
| 20 | 20 | | Pool and Spa Safety Act (15 U.S.C. Section 8001 et seq.). |

| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2009. |
