88 caseworker replacement program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 40.0324, Human Resources Code, is
1111 amended to read as follows:
1212 Sec. 40.0324. CASEWORKER REPLACEMENT PROGRAM. (a) In this
1313 section:
1414 (1) "Caseworker" means a full-time department
1515 employee who serves as a child protective services specialist.
1616 (2) "Training academy" means an entity established by
1717 the department to train caseworkers.
1818 (a-1) The [To the extent that funding is available, the]
1919 department shall develop a program to provide for the timely
2020 replacement of caseworkers with trainees hired in anticipation of
2121 vacancies.
2222 (b) In developing the program, the department shall:
2323 (1) remove the limit on the number of authorized
2424 positions for a category of caseworker in a region of the state in
2525 which the turnover rate for that category exceeds 20 percent;
2626 (2) increase the number of trainee positions for a
2727 category of caseworker described by Subdivision (1) in the training
2828 academy in the region to a total that is 140 percent of the number of
2929 trainee positions that existed immediately before September 1,
3030 2009;
3131 (3) maintain the number of trainers and other
3232 necessary positions in the training academy in the region at the
3333 level necessary to accomplish the purposes of Subdivision (2); and
3434 (4) provide available funds as necessary to accomplish
3535 the purposes of this subsection [consider the turnover rate for
3636 caseworkers by region].
3737 SECTION 2. (a) Not later than December 31, 2010, the
3838 Department of Family and Protective Services shall submit a report
3939 to the legislature regarding the effect of Section 40.0324, Human
4040 Resources Code, as amended by this Act, on the retention of
4141 caseworkers in the state.
4242 (b) The report under Subsection (a) of this section must
4343 include an assessment of the continuing need for the caseworker
4444 replacement program under Section 40.0324, Human Resources Code, as
4545 amended by this Act, and a recommendation on whether the program
4646 should be continued.
4747 SECTION 3. This Act takes effect September 1, 2009.
