55 relating to a study by the Texas Commission on Environmental
66 Quality of methods for disposing of unused pharmaceuticals so that

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. (a) In this section, "commission" means the
1010 Texas Commission on Environmental Quality.
1111 (b) The commission shall study and make recommendations
1212 regarding the methods to be used by consumers, health care
1313 providers, and others for disposing of unused pharmaceuticals so
1414 that they do not enter a wastewater system. In conducting the
1515 study, the commission shall consider:
1616 (1) the methods currently used in this state by
1717 consumers, health care providers, and others for that purpose;
1818 (2) alternative methods used for that purpose,
1919 including the methods used in other states; and
2020 (3) the effects on public health and the environment
2121 of the various methods used for that purpose.
2222 (c) In conducting the study, the commission may solicit
2323 input from:
2424 (1) the Health and Human Services Commission;
2525 (2) the Department of Public Safety of the State of
2626 Texas;
2727 (3) pharmaceutical manufacturers;
2828 (4) pharmacies;
2929 (5) health care providers, including home health care
3030 providers;
3131 (6) hospitals;
3232 (7) clinics;
3333 (8) long-term care facilities;
3434 (9) entities that engage in medical waste processing
3535 and handling;
3636 (10) solid waste management service providers;
3737 (11) local governments;
3838 (12) ranchers and farmers;
3939 (13) end users of medication;
4040 (14) water utilities and other water suppliers;
4141 (15) the United States Postal Service;
4242 (16) the United States Environmental Protection
4343 Agency; and
4444 (17) any other entity the commission considers
4545 necessary.
4646 (d) Not later than December 1, 2010, the commission shall
4747 submit a report of the results of the study to the legislature. The
4848 report must include:
4949 (1) the commission's recommendations regarding the
5050 methods to be used by consumers, health care providers, and others
5151 for disposing of unused pharmaceuticals so that they do not enter a
5252 wastewater system; and
5353 (2) an analysis of the feasibility of implementing the
5454 recommended disposal methods on a statewide basis.
5555 (e) This Act expires January 1, 2011.
5656 SECTION 2. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2009.
