55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the award of stipends to nationally certified classroom
88 teachers under the educator excellence awards program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.705, Education Code, is amended to
1111 read as follows:
1212 Sec. 21.705. AWARD PAYMENTS. A school district must use at
1313 least 60 percent of grant funds awarded to the district under this
1414 subchapter to directly award classroom teachers who effectively
1515 improve student achievement as determined by meaningful, objective
1616 measures. The remaining funds must be used only to:
1717 (1) provide stipends to effective mentors or teacher
1818 coaches;
1919 (2) provide stipends to classroom teachers who are
2020 certified in a subject that is designated by the commissioner as
2121 commonly experiencing a critical shortage of teachers;
2222 (3) provide stipends to classroom teachers who are
2323 certified under Subchapter B in the main subject area in which they
2424 teach;
2525 (4) provide stipends to classroom teachers with proven
2626 records of success for improving student performance who are
2727 assigned to campuses at which the district has experienced
2828 difficulty assigning or retaining teachers;
2929 (5) provide stipends to classroom teachers who hold
3030 postgraduate degrees;
3131 (6) provide stipends to classroom teachers who have
3232 obtained national board certification through the National Board
3333 for Professional Teaching Standards;
3434 (7) provide awards to principals who effectively
3535 increase student performance as determined by objective measures;
3636 (8) [(7)] provide awards to other campus employees who
3737 demonstrate excellence; or
3838 (9) [(8)] implement the components of a Teacher
3939 Advancement Program (TAP), including:
4040 (A) an instructionally focused accountability
4141 system; and
4242 (B) the adjustment of teaching schedules to
4343 permit ongoing applied professional growth.
4444 SECTION 2. This Act applies beginning with the 2009-2010
4545 school year.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2009.
