66 AN ACT
77 relating to financial assistance funded from the amounts of certain
88 fees charged to students enrolled at public institutions of higher
99 education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 56, Education Code, is
1212 amended to read as follows:
1313 SUBCHAPTER B. FINANCIAL ASSISTANCE FUNDED
1414 FROM DESIGNATED TUITION AND STUDENT FEES
1515 Sec. 56.0105. DEFINITION. In this subchapter, "student
1616 fee" means a fee authorized by Section 54.504 or a fee or other
1717 charge authorized by Section 55.16(a). The term does not include an
1818 application fee or a fee for participation in a study abroad program
1919 or a field trip or other organized off-campus activity.
2020 Sec. 56.011. RESIDENT UNDERGRADUATE STUDENT ASSISTANCE.
2121 (a) The governing board of each institution of higher education
2222 shall cause to be set aside not less than 20 percent of the total
2323 amount of:
2424 (1) any amount of tuition charged to a resident
2525 undergraduate student under Section 54.0513 in excess of $46 per
2626 semester credit hour;
2727 (2) any student fee first imposed in the 2009 fall
2828 semester or a subsequent semester or term; and
2929 (3) any student fee increase that takes effect in the
3030 2009 fall semester or a subsequent semester or term.
3131 (b) The funds set aside under this section by an institution
3232 shall be used to provide financial assistance for resident
3333 undergraduate students enrolled in the institution.
3434 (c) [(b)] To be eligible for assistance under this section,
3535 a student must establish financial need in accordance with rules
3636 and procedures established by the Texas Higher Education
3737 Coordinating Board. Priority shall be given to students who meet
3838 the coordinating board definition of financial need and whose cost
3939 for tuition and required fees is not met through other non-loan
4040 financial assistance programs.
4141 (d) [(c)] The financial assistance provided under this
4242 section:
4343 (1) may include grants, scholarships, or work-study
4444 programs; and
4545 (2) may not include[,] student loans or[, and] student
4646 loan repayment assistance.
4747 Sec. 56.012. RESIDENT GRADUATE STUDENT ASSISTANCE. (a)
4848 The governing board of each institution of higher education shall
4949 cause to be set aside not less than 15 percent of the total amount
5050 of:
5151 (1) any amount of tuition charged to a resident
5252 student enrolled in a graduate or professional degree program under
5353 Section 54.0513 in excess of $46 per semester credit hour;
5454 (2) any student fee first imposed in the 2009 fall
5555 semester or a subsequent semester or term; and
5656 (3) any student fee increase that takes effect in the
5757 2009 fall semester or a subsequent semester or term.
5858 (b) The funds set aside under this section by an institution
5959 shall be used to provide financial assistance for resident students
6060 enrolled in graduate and professional degree programs at the
6161 institution.
6262 (c) [(b)] To be eligible for assistance under this section,
6363 a student must establish financial need in accordance with rules
6464 and procedures established by the Texas Higher Education
6565 Coordinating Board. Priority shall be given to students who meet
6666 the coordinating board definition of financial need and whose cost
6767 for tuition and required fees is not met through other non-loan
6868 financial assistance programs.
6969 (d) [(c)] The financial assistance provided under this
7070 section:
7171 (1) may include grants, scholarships, or work-study
7272 programs; and
7373 (2) may not include[,] student loans or[, and] student
7474 loan repayment assistance.
7575 Sec. 56.013. INFORMATION REGARDING FINANCIAL ASSISTANCE
7676 FUNDED FROM DESIGNATED TUITION AND STUDENT FEES. The Texas Higher
7777 Education Coordinating Board shall disseminate to each public or
7878 accredited private high school in this state information regarding
7979 the financial assistance available under this subchapter and shall
8080 include information designed to educate high school students and
8181 the parents of those students on available opportunities and
8282 required preparation with respect to institutions of higher
8383 education. The coordinating board shall recommend a method of
8484 delivery of the information to parents and students under this
8585 section.
8686 SECTION 2. The change in law made by this Act applies to
8787 student fees and charges charged beginning with the 2009 fall
8888 semester.
8989 SECTION 3. This Act takes effect immediately if it receives
9090 a vote of two-thirds of all the members elected to each house, as
9191 provided by Section 39, Article III, Texas Constitution. If this
9292 Act does not receive the vote necessary for immediate effect, this
9393 Act takes effect September 1, 2009.
