| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 93.012, Property Code, is amended by | |
| 11 | 11 | adding Subsection (c) to read as follows: | |
| 12 | 12 | (c) This section does not affect the contractual right of a | |
| 13 | 13 | landlord that is a governmental entity to vary charges under a lease | |
| 14 | 14 | to fully compensate the governmental entity for the governmental | |
| 15 | 15 | entity's operating costs. | |
| 16 | 16 | SECTION 2. This Act takes effect immediately if it receives | |
| 17 | 17 | a vote of two-thirds of all the members elected to each house, as | |
| 18 | 18 | provided by Section 39, Article III, Texas Constitution. If this | |
| 19 | 19 | Act does not receive the vote necessary for immediate effect, this | |
| 20 | 20 | Act takes effect September 1, 2009. |
