66 AN ACT
77 relating to the establishment of a wellness grant program for
88 individuals with disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 117, Human Resources Code,
1111 is amended by adding Section 117.077 to read as follows:
1212 Sec. 117.077. WELLNESS GRANT PROGRAM FOR CERTAIN
1313 INDIVIDUALS. (a) The department shall establish a program to award
1414 grants to public and nonprofit organizations that promote good
1515 health, disease prevention, and wellness for individuals with
1616 disabilities.
1717 (b) To apply for a grant under this section, an applicant
1818 must submit an application in the form and manner prescribed by the
1919 department.
2020 (c) The types of programs that may be funded by grants under
2121 this section include:
2222 (1) programs designed to assist with smoking
2323 cessation, weight control, nutrition, or fitness that focus on the
2424 unique challenges faced by individuals with disabilities;
2525 (2) preventive health screening programs to reduce the
2626 incidence of secondary conditions; and
2727 (3) athletic, exercise, or sports programs that
2828 provide individuals with disabilities an opportunity to increase
2929 the individual's level of physical activity in a dedicated or
3030 adaptive recreational environment.
3131 (d) The executive commissioner may appoint an advisory
3232 committee consisting of interested individuals with relevant
3333 expertise to:
3434 (1) review grant applications and make
3535 recommendations to the department; and
3636 (2) evaluate the progress of the program.
3737 (e) The department shall establish an outreach program to
3838 inform public and nonprofit organizations of the existence of the
3939 grant program and the application requirements.
4040 (f) Not later than December 1 of each even-numbered year,
4141 the department shall submit a report to the legislature summarizing
4242 the activities, funding, and outcomes of programs awarded a grant
4343 under this section and providing recommendations regarding the
4444 grant program.
4545 (g) The department may solicit and accept gifts, grants, and
4646 donations of money from the federal government, local governments,
4747 private corporations, and other persons to be used for the purposes
4848 of the grant program.
4949 SECTION 2. If before implementing any provision of this Act
5050 a state agency determines that a waiver or authorization from a
5151 federal agency is necessary for implementation of that provision,
5252 the agency affected by the provision shall request the waiver or
5353 authorization and may delay implementing that provision until the
5454 waiver or authorization is granted.
5555 SECTION 3. This Act takes effect September 1, 2009.
