7 | 7 | | form of identification as proof of identity for an applicant for a |
---|
8 | 8 | | driver's license or commercial driver's license. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Subsection (a), Section 521.142, Transportation |
---|
11 | 11 | | Code, is amended to read as follows: |
---|
12 | 12 | | (a) An application for an original license must state the |
---|
13 | 13 | | applicant's full name and place and date of birth. This information |
---|
14 | 14 | | must be verified by presentation of proof of identity satisfactory |
---|
15 | 15 | | to the department. The department must accept as satisfactory |
---|
16 | 16 | | proof of identity under this subsection an offender identification |
---|
17 | 17 | | card or similar form of identification issued to an inmate by the |
---|
18 | 18 | | Texas Department of Criminal Justice if the applicant also provides |
---|
19 | 19 | | supplemental verifiable records or documents that aid in |
---|
20 | 20 | | establishing identity. |
---|
21 | 21 | | SECTION 2. Subchapter G, Chapter 521, Transportation Code, |
---|
22 | 22 | | is amended by adding Section 521.1421 to read as follows: |
---|
23 | 23 | | Sec. 521.1421. INMATE IDENTIFICATION VERIFICATION PILOT |
---|
24 | 24 | | PROGRAM. (a) The department shall participate in an inmate |
---|
25 | 25 | | identification verification pilot program for the purpose of |
---|
26 | 26 | | issuing driver's licenses and personal identification certificates |
---|
27 | 27 | | to inmates of the Texas Department of Criminal Justice. |
---|
28 | 28 | | (b) Under the pilot program, the department may: |
---|
29 | 29 | | (1) enter into a contract with the Texas Department of |
---|
30 | 30 | | Criminal Justice and the Department of State Health Services to |
---|
31 | 31 | | establish an identification verification process for inmates of the |
---|
32 | 32 | | Texas Department of Criminal Justice; and |
---|
33 | 33 | | (2) issue a driver's license or a personal |
---|
34 | 34 | | identification certificate to an inmate whose identity has been |
---|
35 | 35 | | confirmed through the verification process and who otherwise meets |
---|
36 | 36 | | the requirements for the issuance of the driver's license or |
---|
37 | 37 | | personal identification certificate. |
---|
38 | 38 | | (c) At the conclusion of the pilot program the governing |
---|
39 | 39 | | bodies of the participating agencies may agree to continue the |
---|
40 | 40 | | pilot program on a permanent basis. |
---|
41 | 41 | | (d) Not later than December 1, 2010, the department and the |
---|
42 | 42 | | Texas Department of Criminal Justice shall jointly issue a report |
---|
43 | 43 | | to the standing committees of the legislature with jurisdiction |
---|
44 | 44 | | over issues related to criminal justice and homeland security |
---|
45 | 45 | | addressing: |
---|
46 | 46 | | (1) the status of the pilot program; |
---|
47 | 47 | | (2) the effectiveness of the pilot program; and |
---|
48 | 48 | | (3) an analysis of the feasibility of implementing a |
---|
49 | 49 | | statewide program based on the pilot program. |
---|
50 | 50 | | SECTION 3. Subsection (c-1), Section 522.021, |
---|
51 | 51 | | Transportation Code, is amended to read as follows: |
---|
52 | 52 | | (c-1) If the department requires proof of an applicant's |
---|
53 | 53 | | identity as part of an application under this section, the |
---|
54 | 54 | | department must accept as satisfactory proof of identity an |
---|
55 | 55 | | offender identification card or similar form of identification |
---|
56 | 56 | | issued to an inmate by the Texas Department of Criminal Justice if |
---|
57 | 57 | | the applicant also provides supplemental verifiable records or |
---|
58 | 58 | | documents that aid in establishing identity. |
---|
59 | 59 | | SECTION 4. The changes in law made by this Act apply only to |
---|
60 | 60 | | an application for a driver's license, commercial driver's license, |
---|
61 | 61 | | or personal identification certificate submitted on or after the |
---|
62 | 62 | | effective date of this Act. An application for a driver's license, |
---|
63 | 63 | | commercial driver's license, or personal identification |
---|
64 | 64 | | certificate submitted before the effective date of this Act is |
---|
65 | 65 | | subject to the law in effect on the date the application was |
---|
66 | 66 | | submitted, and that law is continued in effect for that purpose. |
---|
67 | 67 | | SECTION 5. This Act takes effect September 1, 2009. |
