55 AN ACT
66 relating to the use of an offender identification card or similar
77 form of identification as proof of identity for an applicant for a
88 driver's license or commercial driver's license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Section 521.142, Transportation
1111 Code, is amended to read as follows:
1212 (a) An application for an original license must state the
1313 applicant's full name and place and date of birth. This information
1414 must be verified by presentation of proof of identity satisfactory
1515 to the department. The department must accept as satisfactory
1616 proof of identity under this subsection an offender identification
1717 card or similar form of identification issued to an inmate by the
1818 Texas Department of Criminal Justice if the applicant also provides
1919 supplemental verifiable records or documents that aid in
2020 establishing identity.
2121 SECTION 2. Subchapter G, Chapter 521, Transportation Code,
2222 is amended by adding Section 521.1421 to read as follows:
2323 Sec. 521.1421. INMATE IDENTIFICATION VERIFICATION PILOT
2424 PROGRAM. (a) The department shall participate in an inmate
2525 identification verification pilot program for the purpose of
2626 issuing driver's licenses and personal identification certificates
2727 to inmates of the Texas Department of Criminal Justice.
2828 (b) Under the pilot program, the department may:
2929 (1) enter into a contract with the Texas Department of
3030 Criminal Justice and the Department of State Health Services to
3131 establish an identification verification process for inmates of the
3232 Texas Department of Criminal Justice; and
3333 (2) issue a driver's license or a personal
3434 identification certificate to an inmate whose identity has been
3535 confirmed through the verification process and who otherwise meets
3636 the requirements for the issuance of the driver's license or
3737 personal identification certificate.
3838 (c) At the conclusion of the pilot program the governing
3939 bodies of the participating agencies may agree to continue the
4040 pilot program on a permanent basis.
4141 (d) Not later than December 1, 2010, the department and the
4242 Texas Department of Criminal Justice shall jointly issue a report
4343 to the standing committees of the legislature with jurisdiction
4444 over issues related to criminal justice and homeland security
4545 addressing:
4646 (1) the status of the pilot program;
4747 (2) the effectiveness of the pilot program; and
4848 (3) an analysis of the feasibility of implementing a
4949 statewide program based on the pilot program.
5050 SECTION 3. Subsection (c-1), Section 522.021,
5151 Transportation Code, is amended to read as follows:
5252 (c-1) If the department requires proof of an applicant's
5353 identity as part of an application under this section, the
5454 department must accept as satisfactory proof of identity an
5555 offender identification card or similar form of identification
5656 issued to an inmate by the Texas Department of Criminal Justice if
5757 the applicant also provides supplemental verifiable records or
5858 documents that aid in establishing identity.
5959 SECTION 4. The changes in law made by this Act apply only to
6060 an application for a driver's license, commercial driver's license,
6161 or personal identification certificate submitted on or after the
6262 effective date of this Act. An application for a driver's license,
6363 commercial driver's license, or personal identification
6464 certificate submitted before the effective date of this Act is
6565 subject to the law in effect on the date the application was
6666 submitted, and that law is continued in effect for that purpose.
6767 SECTION 5. This Act takes effect September 1, 2009.
