66 AN ACT
77 relating to an exemption from the sales tax on handguns, rifles,
88 shotguns, and ammunition.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended
1111 by adding Section 151.344 to read as follows:
1212 Sec. 151.344. HANDGUNS, RIFLES, SHOTGUNS, AND AMMUNITION.
1313 The sale of a handgun, a rifle, a shotgun, or ammunition for a
1414 handgun, rifle, or shotgun is exempted from the taxes imposed by
1515 this chapter if the sale takes place during a period beginning at
1616 12:01 a.m. on the Friday preceding the second to last Monday in
1717 August and ending at 11:59 p.m. on the second to last Sunday in
1818 August.
1919 SECTION 2. The change in law made by this Act does not
2020 affect tax liability accruing before the effective date of this
2121 Act. That liability continues in effect as if this Act had not been
2222 enacted, and the former law is continued in effect for the
2323 collection of taxes due and for civil and criminal enforcement of
2424 the liability for those taxes.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
