| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1038.051(d), Special District Local Laws |
|---|
| 10 | 10 | | Code, as effective April 1, 2009, is amended to read as follows: |
|---|
| 11 | 11 | | (d) An election shall be held on the uniform election date |
|---|
| 12 | 12 | | in May of each year to elect the appropriate number of directors |
|---|
| 13 | 13 | | [Section 41.001, Election Code, applies to an election held under |
|---|
| 14 | 14 | | this section]. |

| 15 | 15 | | SECTION 2. Section 1038.052, Special District Local Laws |
|---|
| 16 | 16 | | Code, as effective April 1, 2009, is amended to read as follows: |

| 17 | 17 | | Sec. 1038.052. NOTICE OF ELECTION. The [At least 30 days |
|---|
| 18 | 18 | | before the date of an election of directors, the] board shall |
|---|
| 19 | 19 | | publish notice of the election [one time] in a newspaper or |
|---|
| 20 | 20 | | newspapers that individually or collectively have general |
|---|
| 21 | 21 | | circulation in the district in accordance with Section 4.003, |
|---|
| 22 | 22 | | Election Code. |

| 23 | 23 | | SECTION 3. Section 1038.062, Special District Local Laws |
|---|
| 24 | 24 | | Code, as effective April 1, 2009, is amended by adding Subsections |
|---|
| 25 | 25 | | (e) and (f) to read as follows: |
|---|
| 26 | 26 | | (e) The board may employ physicians and other health care |
|---|
| 27 | 27 | | providers as the board considers necessary for the efficient |
|---|
| 28 | 28 | | operation of the district. |
|---|
| 29 | 29 | | (f) This section may not be construed as authorizing the |
|---|
| 30 | 30 | | board to supervise or control the practice of medicine, as |
|---|
| 31 | 31 | | prohibited by Subtitle B, Title 3, Occupations Code. |
|---|
| 32 | 32 | | SECTION 4. Section 1038.301, Special District Local Laws |
|---|
| 33 | 33 | | Code, as effective April 1, 2009, is amended by adding Subsection |
|---|
| 34 | 34 | | (e) to read as follows: |
|---|
| 35 | 35 | | (e) Section 41.001(a), Election Code, does not apply to an |
|---|
| 36 | 36 | | election ordered under this section. |
|---|
| 37 | 37 | | SECTION 5. Section 1038.007, Special District Local Laws |
|---|
| 38 | 38 | | Code, as effective April 1, 2009, is repealed. |
|---|
| 39 | 39 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2009. |
