77 relating to the Hardeman County Hospital District.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1038.051(d), Special District Local Laws
1010 Code, as effective April 1, 2009, is amended to read as follows:
1111 (d) An election shall be held on the uniform election date
1212 in May of each year to elect the appropriate number of directors
1313 [Section 41.001, Election Code, applies to an election held under
1414 this section].
1515 SECTION 2. Section 1038.052, Special District Local Laws
1616 Code, as effective April 1, 2009, is amended to read as follows:
1717 Sec. 1038.052. NOTICE OF ELECTION. The [At least 30 days
1818 before the date of an election of directors, the] board shall
1919 publish notice of the election [one time] in a newspaper or
2020 newspapers that individually or collectively have general
2121 circulation in the district in accordance with Section 4.003,
2222 Election Code.
2323 SECTION 3. Section 1038.062, Special District Local Laws
2424 Code, as effective April 1, 2009, is amended by adding Subsections
2525 (e) and (f) to read as follows:
2626 (e) The board may employ physicians and other health care
2727 providers as the board considers necessary for the efficient
2828 operation of the district.
2929 (f) This section may not be construed as authorizing the
3030 board to supervise or control the practice of medicine, as
3131 prohibited by Subtitle B, Title 3, Occupations Code.
3232 SECTION 4. Section 1038.301, Special District Local Laws
3333 Code, as effective April 1, 2009, is amended by adding Subsection
3434 (e) to read as follows:
3535 (e) Section 41.001(a), Election Code, does not apply to an
3636 election ordered under this section.
3737 SECTION 5. Section 1038.007, Special District Local Laws
3838 Code, as effective April 1, 2009, is repealed.
3939 SECTION 6. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2009.
