6	6	AN ACT
7	7	relating to the powers and duties of the Castro County Hospital
8	8	District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 1013.052, Special District Local Laws
11	11	Code, as effective April 1, 2009, is amended to read as follows:
12	12	Sec. 1013.052. NOTICE OF ELECTION. Notice [Not earlier
13	13	than the 30th day or later than the 10th day before the date] of an
14	14	election of directors [, notice of the election] shall be published
15	15	[one time] in a newspaper of general circulation in Castro County in
16	16	accordance with Section 4.003, Election Code.
17	17	SECTION 2. Section 1013.062, Special District Local Laws
18	18	Code, as effective April 1, 2009, is amended to read as follows:
19	19	Sec. 1013.062. RECRUITMENT OF MEDICAL STAFF AND
20	20	EMPLOYEES. (a) The board may spend district money, enter into
21	21	agreements, and take other necessary action to recruit physicians
22	22	and other persons to serve as medical staff members or district
23	23	employees, including:
24	24	(1) advertising and marketing;
25	25	(2) paying travel, recruitment, and relocation
26	26	expenses;
27	27	(3) providing a loan or scholarship to a physician or a
28	28	person who:
29	29	(A) is currently enrolled in health care
30	30	education courses at an institution of higher education; and
31	31	(B) contractually agrees to become a district
32	32	employee or medical staff member; and
33	33	(4) providing on a rent-free basis or subsidizing the
34	34	cost of office space or other facilities for a health care
35	35	professional, including a physician.
36	36	(b) The board may employ physicians or other health care
37	37	providers as the board considers necessary for the efficient
38	38	operation of the district.
39	39	(c) This section may not be construed as authorizing the
40	40	board to supervise or control the practice of medicine, as
41	41	prohibited by Subtitle B, Title 3, Occupations Code.
42	42	SECTION 3. Subchapter E, Chapter 1013, Special District
43	43	Local Laws Code, as effective April 1, 2009, is amended by adding
44	44	Sections 1013.209 and 1013.210 to read as follows:
45	45	Sec. 1013.209. ADDITIONAL MEANS OF SECURING REPAYMENT OF
46	46	BONDS. In addition to the authority to issue general obligation
47	47	bonds and revenue bonds under this subchapter, the board may
48	48	provide for the security and payment of district bonds from a pledge
49	49	of a combination of ad valorem taxes as authorized by Section
50	50	1013.202 and revenue and other sources authorized by Section
51	51	1013.206.
52	52	Sec. 1013.210. USE OF BOND PROCEEDS. The district may use
53	53	the proceeds of bonds issued under this subchapter to pay:
54	54	(1) any expense the board determines is reasonable and
55	55	necessary to insure, sell, and deliver the bonds;
56	56	(2) interest payments on the bonds during a period of
57	57	acquisition or construction of a project or facility to be provided
58	58	through the bonds, not to exceed five years;
59	59	(3) costs related to the operation and maintenance of
60	60	a project or facility to be provided through the bonds:
61	61	(A) during an estimated period of acquisition or
62	62	construction, not to exceed five years; and
63	63	(B) for one year after the project or facility is
64	64	acquired or constructed;
65	65	(4) costs related to the financing of the bond funds,
66	66	including debt service reserve and contingency funds;
67	67	(5) costs related to the bond issuance;
68	68	(6) costs related to the acquisition of land or
69	69	interests in land for a project or facility to be provided through
70	70	the bonds; and
71	71	(7) costs of construction of a project or facility to
72	72	be provided through the bonds, including the payment of related
73	73	professional services and expenses.
74	74	SECTION 4. This Act takes effect immediately if it receives
75	75	a vote of two-thirds of all the members elected to each house, as
76	76	provided by Section 39, Article III, Texas Constitution. If this
77	77	Act does not receive the vote necessary for immediate effect, this
78	78	Act takes effect September 1, 2009.
