77 relating to the powers and duties of the Castro County Hospital
88 District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1013.052, Special District Local Laws
1111 Code, as effective April 1, 2009, is amended to read as follows:
1212 Sec. 1013.052. NOTICE OF ELECTION. Notice [Not earlier
1313 than the 30th day or later than the 10th day before the date] of an
1414 election of directors [, notice of the election] shall be published
1515 [one time] in a newspaper of general circulation in Castro County in
1616 accordance with Section 4.003, Election Code.
1717 SECTION 2. Section 1013.062, Special District Local Laws
1818 Code, as effective April 1, 2009, is amended to read as follows:
1919 Sec. 1013.062. RECRUITMENT OF MEDICAL STAFF AND
2020 EMPLOYEES. (a) The board may spend district money, enter into
2121 agreements, and take other necessary action to recruit physicians
2222 and other persons to serve as medical staff members or district
2323 employees, including:
2424 (1) advertising and marketing;
2525 (2) paying travel, recruitment, and relocation
2626 expenses;
2727 (3) providing a loan or scholarship to a physician or a
2828 person who:
2929 (A) is currently enrolled in health care
3030 education courses at an institution of higher education; and
3131 (B) contractually agrees to become a district
3232 employee or medical staff member; and
3333 (4) providing on a rent-free basis or subsidizing the
3434 cost of office space or other facilities for a health care
3535 professional, including a physician.
3636 (b) The board may employ physicians or other health care
3737 providers as the board considers necessary for the efficient
3838 operation of the district.
3939 (c) This section may not be construed as authorizing the
4040 board to supervise or control the practice of medicine, as
4141 prohibited by Subtitle B, Title 3, Occupations Code.
4242 SECTION 3. Subchapter E, Chapter 1013, Special District
4343 Local Laws Code, as effective April 1, 2009, is amended by adding
4444 Sections 1013.209 and 1013.210 to read as follows:
4545 Sec. 1013.209. ADDITIONAL MEANS OF SECURING REPAYMENT OF
4646 BONDS. In addition to the authority to issue general obligation
4747 bonds and revenue bonds under this subchapter, the board may
4848 provide for the security and payment of district bonds from a pledge
4949 of a combination of ad valorem taxes as authorized by Section
5050 1013.202 and revenue and other sources authorized by Section
5151 1013.206.
5252 Sec. 1013.210. USE OF BOND PROCEEDS. The district may use
5353 the proceeds of bonds issued under this subchapter to pay:
5454 (1) any expense the board determines is reasonable and
5555 necessary to insure, sell, and deliver the bonds;
5656 (2) interest payments on the bonds during a period of
5757 acquisition or construction of a project or facility to be provided
5858 through the bonds, not to exceed five years;
5959 (3) costs related to the operation and maintenance of
6060 a project or facility to be provided through the bonds:
6161 (A) during an estimated period of acquisition or
6262 construction, not to exceed five years; and
6363 (B) for one year after the project or facility is
6464 acquired or constructed;
6565 (4) costs related to the financing of the bond funds,
6666 including debt service reserve and contingency funds;
6767 (5) costs related to the bond issuance;
6868 (6) costs related to the acquisition of land or
6969 interests in land for a project or facility to be provided through
7070 the bonds; and
7171 (7) costs of construction of a project or facility to
7272 be provided through the bonds, including the payment of related
7373 professional services and expenses.
7474 SECTION 4. This Act takes effect immediately if it receives
7575 a vote of two-thirds of all the members elected to each house, as
7676 provided by Section 39, Article III, Texas Constitution. If this
7777 Act does not receive the vote necessary for immediate effect, this
7878 Act takes effect September 1, 2009.
