55 relating to the approval of certain construction, repair, or
66 rehabilitation projects at public institutions of higher education
77 in this state.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 61.058, Education Code, is amended by
1010 amending Subsection (a) and adding Subsection (c) to read as
1111 follows:
1212 (a) Except as provided by Subsection (b) of this section,
1313 the board shall approve or disapprove all new construction and
1414 repair and rehabilitation of all buildings and facilities at
1515 institutions of higher education financed from any source provided
1616 that:
1717 (A) the board's consideration and determination
1818 shall be limited to the purpose for which the new or remodeled
1919 buildings are to be used to assure conformity with approved space
2020 utilization standards and the institution's approved programs and
2121 role and mission if the cost of the project is not more than
2222 $4,000,000 [$2,000,000], but the board may consider cost factors
2323 and the financial implications of the project to the state if the
2424 total cost is in excess of $4,000,000 [$2,000,000];
2525 (B) the requirement of approval for new
2626 construction applies only to projects the total cost of which is in
2727 excess of $4,000,000 [$1,000,000];
2828 (C) the requirement of approval for major repair
2929 and rehabilitation of buildings and facilities applies only to a
3030 project the total cost of which is more than $4,000,000
3131 [$2,000,000];
3232 (D) the requirement of approval or disapproval by
3333 the board does not apply to any new construction or major repair and
3434 rehabilitation project that is specifically approved by the
3535 legislature;
3636 (E) the requirement of approval by the board does
3737 not apply to a junior college's construction, repair, or
3838 rehabilitation financed entirely with funds from a source other
3939 than the state, including funds from ad valorem tax receipts of the
4040 college, gifts, grants, and donations to the college, and student
4141 fees; and
4242 (F) the requirement of approval by the board does
4343 not apply to construction, repair, or rehabilitation of privately
4444 owned buildings and facilities located on land leased from an
4545 institution of higher education if the construction, repair, or
4646 rehabilitation is financed entirely from funds not under the
4747 control of the institution, and provided further that:
4848 (i) the buildings and facilities are to be
4949 used exclusively for auxiliary enterprises; and
5050 (ii) the buildings and facilities will not
5151 require appropriations from the legislature for operation,
5252 maintenance, or repair unless approval by the board has been
5353 obtained.
5454 (c) As necessary to ensure that the board is required to
5555 approve only substantial construction, repair, or rehabilitation
5656 projects at institutions of higher education, for all projects
5757 described by Subsection (a)(B) or (a)(C) the board by rule may
5858 increase the total cost threshold required for board approval under
5959 this section.
6060 SECTION 2. The change in law made by this Act in amending
6161 Section 61.058, Education Code, applies only to a project for which
6262 an institution of higher education submits an initial application
6363 for approval on or after the effective date of this Act. A project
6464 for which an institution of higher education submits an initial
6565 application for approval before the effective date of this Act is
6666 covered by the law in effect when the institution submitted the
6767 initial application, and the former law is continued in effect for
6868 that purpose.
6969 SECTION 3. This Act takes effect September 1, 2009.
