| 5 | 5 | | relating to certifying the eligibility of certain educational aides |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (d), Section 54.214, Education Code, |
|---|
| 10 | 10 | | is amended to read as follows: |
|---|
| 11 | 11 | | (d) The institution of higher education at which a person |
|---|
| 12 | 12 | | seeking an exemption under this section is enrolled [coordinating |
|---|
| 13 | 13 | | board] must certify the [a] person's eligibility to receive the |
|---|
| 14 | 14 | | [an] exemption [under this section]. As soon as practicable after |
|---|
| 15 | 15 | | receiving an application for certification, the institution |
|---|
| 16 | 16 | | [coordinating board] shall make the determination of eligibility |
|---|
| 17 | 17 | | and give notice of its determination to the applicant[, the |
|---|
| 18 | 18 | | institution of higher education at which the applicant is |
|---|
| 19 | 19 | | enrolled,] and to the school district employing the applicant |
|---|
| 20 | 20 | | [person] as an educational aide. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 22 | 22 | | 54.214, Education Code, applies to an exemption from tuition and |
|---|
| 23 | 23 | | fees granted under that section beginning with the 2009 fall |
|---|
| 24 | 24 | | semester. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
