55 AN ACT
66 relating to the creation of a task force to study and develop
77 uniform reentry procedures for essential personnel entering an area
88 evacuated during a disaster or other emergency.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 418.018, Government Code, is amended by
1111 adding Subsections (d), (e), and (f) to read as follows:
1212 (d) The governor's division of emergency management, in
1313 cooperation with the Department of Public Safety, shall create a
1414 task force to study and develop uniform reentry procedures for
1515 essential personnel entering a disaster area or a stricken or
1616 threatened area that has been evacuated. The task force shall
1717 submit a written report on the procedures developed by the task
1818 force to the governor. The procedures must:
1919 (1) authorize the orderly reentry of essential
2020 personnel according to the critical functions provided by the
2121 personnel in restoring normal operations to the area following an
2222 evacuation;
2323 (2) prioritize the order of reentry for the essential
2424 personnel, including emergency responders, search and rescue
2525 personnel, infrastructure and utility repair personnel, official
2626 damage assessment personnel, health care providers, and businesses
2727 essential to the return of residents; and
2828 (3) establish methods to authenticate the identity of
2929 the personnel authorized to reenter the area.
3030 (e) The task force created under Subsection (d) must include
3131 representatives of:
3232 (1) the office of the governor;
3333 (2) the Department of Public Safety;
3434 (3) emergency responders;
3535 (4) search and rescue personnel;
3636 (5) infrastructure and utility repair personnel;
3737 (6) official damage assessment personnel;
3838 (7) health care providers;
3939 (8) county judges and mayors; and
4040 (9) businesses essential to the return of residents.
4141 (f) Based on the report and procedures developed by the task
4242 force created under Subsection (d) and in cooperation with the
4343 Department of Public Safety, the governor by rule shall establish
4444 uniform reentry procedures for essential personnel entering a
4545 disaster area or a stricken or threatened area that has been
4646 evacuated. The rules adopted under this section shall not diminish
4747 the authority of local emergency management officials to adopt
4848 appropriate reentry provisions in a local plan or to make decisions
4949 on the timing and implementation of reentry activities.
5050 SECTION 2. As soon as practicable after the effective date
5151 of this Act, the governor, in cooperation with the Department of
5252 Public Safety of the State of Texas, shall:
5353 (1) appoint members to the task force created under
5454 Subsection (d), Section 418.018, Government Code, as added by this
5555 Act; and
5656 (2) based on the report and procedures developed by
5757 the task force, adopt rules on uniform reentry procedures for
5858 essential personnel as required by Subsection (f), Section 418.018,
5959 Government Code, as added by this Act.
6060 SECTION 3. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2009.
