55 relating to the 39th Judicial District Juvenile Board.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 152.1101, Human Resources Code, is
88 amended to read as follows:
99 Sec. 152.1101. HASKELL COUNTY. (a) Haskell County is
1010 included in the 39th Judicial District Juvenile Board. The
1111 juvenile board [of Haskell County] is composed of:
1212 (1) the county judge of Haskell County;
1313 (2) the county judge of Kent County;
1414 (3) the county judge of Stonewall County;
1515 (4) the county judge of Throckmorton County; and
1616 (5) the 39th Judicial District judge[, the district
1717 judges in Haskell County, and the judge of any statutory court
1818 designated as a juvenile court].
1919 (b) The juvenile court judge may appoint two public members
2020 to serve on the board for a term set by the judge.
2121 (c) [(b)] The juvenile board shall elect one of its members
2222 as chairman at the beginning of each year.
2323 (d) [(c)] The commissioners court of each county shall pay
2424 the county judge of that county and the 39th Judicial District judge
2525 additional [judges on the board an] annual compensation of [salary
2626 set by the commissioners court at] not more than $6,000 [$1,200],
2727 payable in equal monthly installments from the general fund or any
2828 other available fund of the county, for the added duties imposed on
2929 the judges under this section. The public members serve without
3030 compensation.
3131 [(d) The chief juvenile probation officer may set the
3232 salaries and allowances of juvenile probation personnel with the
3333 approval of the board.]
3434 (e) If approved by the juvenile board, the commissioners
3535 court shall reimburse the juvenile court judge for the judge's
3636 actual and necessary expenses incurred in attending seminars and
3737 other educational or instructional meetings related to juvenile
3838 problems. The counties shall prorate the expenses allowed for the
3939 members of the juvenile board and for the juvenile court judge.
4040 (f) The commissioners court of each county shall jointly
4141 provide the necessary funds to pay the salaries of the juvenile
4242 probation personnel in the amount set by the juvenile board.
4343 (g) The commissioners court of each county shall jointly pay
4444 the expenses of the juvenile probation officers that are certified
4545 as necessary by the juvenile board chairman from the general fund
4646 and in the amount set by the juvenile board.
4747 (h) Sections 152.0004 and [Section] 152.0005(b) do [does]
4848 not apply to the juvenile board [of Haskell County].
4949 SECTION 2. Subchapter D, Chapter 152, Human Resources Code,
5050 is amended by adding Section 152.1381 to read as follows:
5151 Sec. 152.1381. KENT COUNTY. (a) Kent County is included
5252 in the 39th Judicial District Juvenile Board.
5353 (b) Section 152.1101 applies to the 39th Judicial District
5454 Juvenile Board.
5555 SECTION 3. Subchapter D, Chapter 152, Human Resources Code,
5656 is amended by adding Section 152.2231 to read as follows:
5757 Sec. 152.2231. STONEWALL COUNTY. (a) Stonewall County is
5858 included in the 39th Judicial District Juvenile Board.
5959 (b) Section 152.1101 applies to the 39th Judicial District
6060 Juvenile Board.
6161 SECTION 4. Subsections (a) and (b), Section 152.2301, Human
6262 Resources Code, are amended to read as follows:
6363 (a) Throckmorton County is included in the 39th Judicial
6464 District Juvenile Board. [The juvenile board of Throckmorton
6565 County is composed of the county judge, the district judges in
6666 Throckmorton County, and the judge of each statutory court
6767 designated as a juvenile court in the county. The juvenile court
6868 judge may appoint two public members to serve on the board for a
6969 period determined by the juvenile court judge.]
7070 (b) Section 152.1101 applies to the 39th Judicial District
7171 Juvenile Board. [The juvenile board shall elect one of its members
7272 as chairman at the beginning of each year.]
7373 SECTION 5. Subsections (c), (d), and (e), Section 152.2301,
7474 Human Resources Code, are repealed.
7575 SECTION 6. This Act takes effect September 1, 2009.
