5	5	relating to the 39th Judicial District Juvenile Board.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Section 152.1101, Human Resources Code, is
8	8	amended to read as follows:
9	9	Sec. 152.1101. HASKELL COUNTY. (a) Haskell County is
10	10	included in the 39th Judicial District Juvenile Board. The
11	11	juvenile board [of Haskell County] is composed of:
12	12	(1) the county judge of Haskell County;
13	13	(2) the county judge of Kent County;
14	14	(3) the county judge of Stonewall County;
15	15	(4) the county judge of Throckmorton County; and
16	16	(5) the 39th Judicial District judge[, the district
17	17	judges in Haskell County, and the judge of any statutory court
18	18	designated as a juvenile court].
19	19	(b) The juvenile court judge may appoint two public members
20	20	to serve on the board for a term set by the judge.
21	21	(c) [(b)] The juvenile board shall elect one of its members
22	22	as chairman at the beginning of each year.
23	23	(d) [(c)] The commissioners court of each county shall pay
24	24	the county judge of that county and the 39th Judicial District judge
25	25	additional [judges on the board an] annual compensation of [salary
26	26	set by the commissioners court at] not more than $6,000 [$1,200],
27	27	payable in equal monthly installments from the general fund or any
28	28	other available fund of the county, for the added duties imposed on
29	29	the judges under this section. The public members serve without
30	30	compensation.
31	31	[(d) The chief juvenile probation officer may set the
32	32	salaries and allowances of juvenile probation personnel with the
33	33	approval of the board.]
34	34	(e) If approved by the juvenile board, the commissioners
35	35	court shall reimburse the juvenile court judge for the judge's
36	36	actual and necessary expenses incurred in attending seminars and
37	37	other educational or instructional meetings related to juvenile
38	38	problems. The counties shall prorate the expenses allowed for the
39	39	members of the juvenile board and for the juvenile court judge.
40	40	(f) The commissioners court of each county shall jointly
41	41	provide the necessary funds to pay the salaries of the juvenile
42	42	probation personnel in the amount set by the juvenile board.
43	43	(g) The commissioners court of each county shall jointly pay
44	44	the expenses of the juvenile probation officers that are certified
45	45	as necessary by the juvenile board chairman from the general fund
46	46	and in the amount set by the juvenile board.
47	47	(h) Sections 152.0004 and [Section] 152.0005(b) do [does]
48	48	not apply to the juvenile board [of Haskell County].
49	49	SECTION 2. Subchapter D, Chapter 152, Human Resources Code,
50	50	is amended by adding Section 152.1381 to read as follows:
51	51	Sec. 152.1381. KENT COUNTY. (a) Kent County is included
52	52	in the 39th Judicial District Juvenile Board.
53	53	(b) Section 152.1101 applies to the 39th Judicial District
54	54	Juvenile Board.
55	55	SECTION 3. Subchapter D, Chapter 152, Human Resources Code,
56	56	is amended by adding Section 152.2231 to read as follows:
57	57	Sec. 152.2231. STONEWALL COUNTY. (a) Stonewall County is
58	58	included in the 39th Judicial District Juvenile Board.
59	59	(b) Section 152.1101 applies to the 39th Judicial District
60	60	Juvenile Board.
61	61	SECTION 4. Subsections (a) and (b), Section 152.2301, Human
62	62	Resources Code, are amended to read as follows:
63	63	(a) Throckmorton County is included in the 39th Judicial
64	64	District Juvenile Board. [The juvenile board of Throckmorton
65	65	County is composed of the county judge, the district judges in
66	66	Throckmorton County, and the judge of each statutory court
67	67	designated as a juvenile court in the county. The juvenile court
68	68	judge may appoint two public members to serve on the board for a
69	69	period determined by the juvenile court judge.]
70	70	(b) Section 152.1101 applies to the 39th Judicial District
71	71	Juvenile Board. [The juvenile board shall elect one of its members
72	72	as chairman at the beginning of each year.]
73	73	SECTION 5. Subsections (c), (d), and (e), Section 152.2301,
74	74	Human Resources Code, are repealed.
75	75	SECTION 6. This Act takes effect September 1, 2009.
