| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subsection (c), Section 154.062, Family Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (c) Resources do not include: |
|---|
| 11 | 11 | | (1) return of principal or capital; |
|---|
| 12 | 12 | | (2) accounts receivable; [or] |
|---|
| 13 | 13 | | (3) benefits paid in accordance with the Temporary |
|---|
| 14 | 14 | | Assistance for Needy Families program; or |
|---|
| 15 | 15 | | (4) payments for foster care of a child [aid for |
|---|
| 16 | 16 | | families with dependent children]. |
|---|
| 17 | 17 | | SECTION 2. The change in law made by this Act to Subsection |
|---|
| 18 | 18 | | (c), Section 154.062, Family Code, applies only to a proceeding to |
|---|
| 19 | 19 | | establish or modify a child support obligation that is pending in a |
|---|
| 20 | 20 | | trial court on or filed on or after the effective date of this Act. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect September 1, 2009. |
