55 AN ACT
66 relating to a study and a pilot project with regard to, and the
77 implementation of policies to promote, the adoption of plug-in
88 hybrid electric vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.917 to read as follows:
1212 Sec. 39.917. EVALUATION OF POLICIES REGARDING PLUG-IN
1313 HYBRID ELECTRIC VEHICLES; PILOT PROJECT. (a) In this section,
1414 "plug-in hybrid electric vehicle" means a vehicle that:
1515 (1) draws motive power from a battery with a capacity
1616 of at least four kilowatt-hours;
1717 (2) can be recharged from an external source of
1818 electricity for motive power; and
1919 (3) is a light-duty motor vehicle as defined by
2020 Section 386.151, Health and Safety Code.
2121 (b) The commission shall study the potential for wide-scale
2222 adoption of plug-in hybrid electric vehicles and shall submit a
2323 report to the 82nd Legislature regarding the commission's findings.
2424 The report shall include:
2525 (1) a summary and evaluation of studies by other
2626 organizations relating to the sufficiency of the transmission and
2727 distribution grid and existing generation capacity to charge
2828 vehicles;
2929 (2) a summary and evaluation of studies quantifying
3030 the air quality benefits of the adoption of plug-in hybrid electric
3131 vehicles, particularly in areas that are, or are likely to be,
3232 nonattainment areas;
3333 (3) an evaluation of the sufficiency of existing and
3434 planned metering infrastructure, settlement policies, and retail
3535 pricing offers to provide adequate incentives for customers to
3636 charge vehicles during off-peak hours;
3737 (4) an evaluation by transmission and distribution
3838 utilities of the potential impact of increased loading on
3939 distribution transformers due to increased use of plug-in hybrid
4040 electric vehicles; and
4141 (5) recommendations to the legislature relating to
4242 legislation that the commission finds necessary to support the
4343 adoption of plug-in hybrid electric vehicles while maintaining a
4444 reliable transmission and distribution grid.
4545 (c) Based on the results of the study required by this
4646 section, the commission may adopt rules as necessary to ensure that
4747 adequate electric infrastructure and policies are in place to
4848 support the adoption of plug-in hybrid electric vehicles.
4949 (d) The commission shall consult with the Electric
5050 Reliability Council of Texas, transmission and distribution
5151 utilities, and the Texas Commission on Environmental Quality, as
5252 appropriate, to conduct the study.
5353 (e) The commission shall develop a pilot project, in
5454 consultation with local electric utilities or private contractors,
5555 for the establishment and operation of charging stations for
5656 plug-in hybrid electric vehicles in state-owned parking lots and
5757 garages, including lots and garages in the Capitol Complex, as
5858 defined by Section 411.061, Government Code.
5959 (f) The pilot project must also include:
6060 (1) demonstrations on the use of charging stations for
6161 plug-in hybrid electric vehicles in the Capitol Complex;
6262 (2) the solicitation of demonstrations of plug-in
6363 hybrid electric vehicles, including pickup trucks, delivery
6464 vehicles, and buses, for use in the state vehicle fleet; and
6565 (3) facilitation of the use of ride-sharing or
6666 car-pooling programs that use plug-in hybrid electric vehicles and
6767 are sponsored or promoted by local governments.
6868 (g) The commission may solicit and accept grants, gifts, and
6969 donations from any public or private source for the purposes of this
7070 section.
7171 SECTION 2. This Act takes effect September 1, 2009.
