55 AN ACT
66 relating to erecting an off-premise sign adjacent to and visible
77 from certain roads, including Farm-to-Market Road 1431 between the
88 eastern city limits of the city of Marble Falls and the boundary
99 line between Burnet and Travis Counties and roads that follow the
1010 route of El Camino Real de Tierra Adentro.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsection (a), Section 391.252, Transportation
1313 Code, is amended to read as follows:
1414 (a) A person may not erect an off-premise sign that is
1515 adjacent to and visible from:
1616 (1) U.S. Highway 290 between the western city limits
1717 of the city of Austin and the eastern city limits of the city of
1818 Fredericksburg;
1919 (2) State Highway 317 between the northern city limits
2020 of the city of Belton to the southern city limits of the city of
2121 Valley Mills;
2222 (3) State Highway 16 between the northern city limits
2323 of the city of Kerrville and Interstate Highway 20;
2424 (4) U.S. Highway 77 between State Highway 186 and
2525 State Highway 44;
2626 (5) U.S. Highway 281 between:
2727 (A) State Highway 186 and Interstate Highway 37,
2828 exclusive of the segment of U.S. Highway 281 located in the city
2929 limits of Three Rivers; and
3030 (B) the southern boundary line of Comal County
3131 and State Highway 306;
3232 (6) State Highway 17 between State Highway 118 and
3333 U.S. Highway 90;
3434 (7) State Highway 67 between U.S. Highway 90 and
3535 Farm-to-Market Road 170;
3636 (8) Farm-to-Market Road 170 between State Highway 67
3737 and State Highway 118;
3838 (9) State Highway 118 between Farm-to-Market Road 170
3939 and State Highway 17;
4040 (10) State Highway 105 between the western city limits
4141 of the city of Sour Lake to the eastern city limits of the city of
4242 Cleveland;
4343 (11) State Highway 73 between the eastern city limits
4444 of the city of Winnie to the western city limits of the city of Port
4545 Arthur;
4646 (12) State Highway 21 between the southern city limits
4747 of the city of College Station and U.S. Highway 290;
4848 (13) a highway located in:
4949 (A) the Sabine National Forest;
5050 (B) the Davy Crockett National Forest; or
5151 (C) the Sam Houston National Forest;
5252 (14) Segments 1 through 4 of State Highway 130;
5353 (15) a highway in Bandera County that is part of the
5454 state highway system;
5555 (16) Farm-to-Market Road 3238 beginning at State
5656 Highway 71 and any extension of that road through Hays and Blanco
5757 Counties;
5858 (17) Farm-to-Market Road 2978 between Farm-to-Market
5959 Road 1488 and the boundary line between Harris and Montgomery
6060 Counties;
6161 (18) U.S. Highway 90 between the western city limits
6262 of the city of San Antonio and the eastern city limits of the city of
6363 Hondo; [or]
6464 (19) the following highways in Austin County:
6565 (A) State Highway 159;
6666 (B) Farm-to-Market Road 331;
6767 (C) Farm-to-Market Road 529;
6868 (D) Farm-to-Market Road 1094; and
6969 (E) Farm-to-Market Road 2502;
7070 (20) Farm-to-Market Road 1431 between the eastern city
7171 limits of the city of Marble Falls and the boundary line between
7272 Burnet and Travis Counties; or
7373 (21) the following highway segments that are a part of
7474 the route of El Camino Real de Tierra Adentro:
7575 (A) Farm-to-Market Road 258 between
7676 Farm-to-Market Road 1110 and Loop 375; and
7777 (B) State Highway 20 between State Highway 260
7878 and the border of this state and the state of New Mexico.
7979 SECTION 2. The change in law made to Subsection (a), Section
8080 391.252, Transportation Code, applies only to an off-premise sign
8181 erected on or after the effective date of this Act. An off-premise
8282 sign erected before the effective date of this Act is covered by the
8383 law in effect when the sign was erected, and the former law is
8484 continued in effect for that purpose.
8585 SECTION 3. This Act takes effect September 1, 2009.
