| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter E, Chapter 54, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 54.5351 to read as follows: |
|---|
| 11 | 11 | | Sec. 54.5351. STUDENT ENDOWMENT FUND FEE; THE UNIVERSITY OF |
|---|
| 12 | 12 | | TEXAS AT EL PASO. (a) The board of regents of The University of |
|---|
| 13 | 13 | | Texas System may impose a student endowment fund fee on each student |
|---|
| 14 | 14 | | enrolled at The University of Texas at El Paso. The fee may not be |
|---|
| 15 | 15 | | imposed unless approved by a majority vote of the students |
|---|
| 16 | 16 | | participating in a general student election held at the university |
|---|
| 17 | 17 | | under Section 56.243. |
|---|
| 18 | 18 | | (b) The amount of the fee may not exceed $1 per semester for |
|---|
| 19 | 19 | | each regular semester or summer session, unless the amount is |
|---|
| 20 | 20 | | increased as provided by Subsection (c). |
|---|
| 21 | 21 | | (c) The amount of the fee per semester may be increased from |
|---|
| 22 | 22 | | one academic year to the next only if approved by a majority vote of |
|---|
| 23 | 23 | | the students of the university participating in a general student |
|---|
| 24 | 24 | | election held for that purpose or, if the amount of the increase |
|---|
| 25 | 25 | | does not exceed five percent, by a majority vote of the legislative |
|---|
| 26 | 26 | | body of the student government of the university. |
|---|
| 27 | 27 | | (d) A fee imposed under this section must be used to |
|---|
| 28 | 28 | | establish a student endowment fund under Section 56.247. |
|---|
| 29 | 29 | | (e) A fee imposed under this section is in addition to any |
|---|
| 30 | 30 | | other fee authorized by law and may not be considered in determining |
|---|
| 31 | 31 | | the maximum amount of student services fees that may be imposed |
|---|
| 32 | 32 | | under Section 54.503(b). |
|---|
| 33 | 33 | | SECTION 2. This Act applies beginning with the 2009 fall |
|---|
| 34 | 34 | | semester. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2009. |
