55 AN ACT
66 relating to the disclosure of criminal history record information
77 regarding public school employees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 411.084, Government Code, is amended by
1010 amending Subsection (a) and adding Subsections (a-1) and (c) to
1111 read as follows:
1212 (a) Criminal history record information obtained from the
1313 department under this subchapter, including any identification
1414 information that could reveal the identity of a person about whom
1515 criminal history record information is requested and information
1616 that directly or indirectly indicates or implies involvement of a
1717 person in the criminal justice system:
1818 (1) is for the exclusive use of the authorized
1919 recipient of the information; and
2020 (2) may be disclosed or used by the recipient only if,
2121 and only to the extent that, disclosure or use is authorized or
2222 directed by:
2323 (A) this subchapter;
2424 (B) another statute;
2525 (C) a rule adopted under a statute; or
2626 (D) an order of a court of competent
2727 jurisdiction.
2828 (a-1) The term "criminal history record" information under
2929 Subsection (a) does not refer to any specific document produced to
3030 comply with this subchapter but to the information contained,
3131 wholly or partly, in a document's original form or any subsequent
3232 form or use.
3333 (c) An agency or individual may not confirm the existence or
3434 nonexistence of criminal history record information to any person
3535 that is not eligible to receive the information.
3636 SECTION 2. Subsections (b) and (c), Section 411.090,
3737 Government Code, are amended to read as follows:
3838 (b) Criminal history record information obtained by the
3939 board in the original form or any subsequent form [under Subsection
4040 (a)]:
4141 (1) may be used only for a [any] purpose related to the
4242 issuance, denial, suspension, or cancellation of a certificate
4343 issued by the board;
4444 (2) may not be released to any person except:
4545 (A) the person who is the subject of the
4646 information;
4747 (B) the Texas Education Agency;
4848 (C) a local or regional educational entity as
4949 provided by Section 411.097; or
5050 (D) by [on] court order [or with the consent of
5151 the applicant for a certificate]; [and]
5252 (3) is not subject to disclosure as provided by
5353 Chapter 552; and
5454 (4) shall be destroyed by the board after the
5555 information is used for the authorized purposes.
5656 (c) The department shall notify the State Board for Educator
5757 Certification of the arrest of any educator, as defined by Section
5858 5.001, Education Code, who has fingerprints on file with the
5959 department. Any record of the notification and any information
6060 contained in the notification is not subject to disclosure as
6161 provided by Chapter 552.
6262 SECTION 3. Section 411.0901, Government Code, is amended to
6363 read as follows:
6464 Sec. 411.0901. ACCESS TO CRIMINAL HISTORY RECORD
6565 INFORMATION: TEXAS EDUCATION AGENCY. (a) The Texas Education
6666 Agency is entitled to obtain criminal history record information
6767 maintained by the department about a person who:
6868 (1) is employed or is an applicant for employment by a
6969 school district or open-enrollment charter school;
7070 (2) is employed or is an applicant for employment by a
7171 shared services arrangement, if the employee's or applicant's
7272 duties are or will be performed on school property or at another
7373 location where students are regularly present; or
7474 (3) is employed or is an applicant for employment by an
7575 entity that contracts with a school district, open-enrollment
7676 charter school, or shared services arrangement if:
7777 (A) the employee or applicant has or will have
7878 continuing duties relating to the contracted services; and
7979 (B) the employee or applicant has or will have
8080 direct contact with students.
8181 (b) Criminal history record information obtained by the
8282 agency in the original form or any subsequent form:
8383 (1) may be used only for a purpose authorized by the
8484 Education Code;
8585 (2) may not be released to any person except:
8686 (A) the person who is the subject of the
8787 information;
8888 (B) the State Board for Educator Certification;
8989 (C) a local or regional educational entity as
9090 provided by Section 411.097; or
9191 (D) by court order;
9292 (3) is not subject to disclosure as provided by
9393 Chapter 552; and
9494 (4) shall be destroyed by the agency after the
9595 information is used for the authorized purposes.
9696 SECTION 4. Section 411.097, Government Code, is amended by
9797 amending Subsection (d) and adding Subsection (f) to read as
9898 follows:
9999 (d) Criminal history record information obtained by a
100100 school district, charter school, private school, service center,
101101 commercial transportation company, or shared services arrangement
102102 in the original form or any subsequent form:
103103 (1) [under Subsection (a), (b), or (c)] may not be
104104 released [or disclosed] to any person except:
105105 (A) [, other than] the individual who is the
106106 subject of the information;
107107 (B) [,] the Texas Education Agency;
108108 (C) [,] the State Board for Educator
109109 Certification;
110110 (D) [, or] the chief personnel officer of the
111111 transportation company, if the information is obtained under
112112 Subsection (a)(2); or
113113 (E) by court order;
114114 (2) is not subject to disclosure as provided by
115115 Chapter 552; and
116116 (3) shall be destroyed by the school district, charter
117117 school, private school, service center, commercial transportation
118118 company, or shared services arrangement on the earlier of:
119119 (A) the first anniversary of the date the
120120 information was originally obtained; or
121121 (B) the date the information is used for the
122122 authorized purpose.
123123 (f) An employee of a school district, charter school,
124124 private school, regional education service center, commercial
125125 transportation company, or education shared services arrangement
126126 or an entity that contracts to provide services to a school
127127 district, charter school, or shared services arrangement may
128128 request from the employer a copy of any criminal history record
129129 information relating to that employee that the employer has
130130 obtained as provided by Subchapter C, Chapter 22, Education Code.
131131 The employer may charge a fee to an employee requesting a copy of
132132 the information in an amount not to exceed the actual cost of
133133 copying the requested criminal history record information.
134134 SECTION 5. Subchapter C, Chapter 22, Education Code, is
135135 amended by adding Section 22.08391 to read as follows:
136136 Sec. 22.08391. CONFIDENTIALITY OF INFORMATION.
137137 (a) Information collected about a person to comply with this
138138 subchapter, including the person's name, address, phone number,
139139 social security number, driver's license number, other
140140 identification number, and fingerprint records:
141141 (1) may not be released except:
142142 (A) to comply with this subchapter;
143143 (B) by court order; or
144144 (C) with the consent of the person who is the
145145 subject of the information;
146146 (2) is not subject to disclosure as provided by
147147 Chapter 552, Government Code; and
148148 (3) shall be destroyed by the requestor or any
149149 subsequent holder of the information not later than the first
150150 anniversary of the date the information is received.
151151 (b) Any criminal history record information received by the
152152 State Board for Educator Certification as provided by this
153153 subchapter is subject to Section 411.090(b), Government Code.
154154 (c) Any criminal history record information received by the
155155 agency as provided by this subchapter is subject to Section
156156 411.0901(b), Government Code.
157157 (d) Any criminal history record information received by a
158158 school district, charter school, private school, regional
159159 education service center, commercial transportation company, or
160160 education shared services arrangement or an entity that contracts
161161 to provide services to a school district, charter school, or shared
162162 services arrangement as provided by this subchapter is subject to
163163 Section 411.097(d), Government Code.
164164 SECTION 6. The change in law made by this Act applies to
165165 information collected, assembled, or maintained before, on, or
166166 after the effective date of this Act.
167167 SECTION 7. This Act takes effect immediately if it receives
168168 a vote of two-thirds of all the members elected to each house, as
169169 provided by Section 39, Article III, Texas Constitution. If this
170170 Act does not receive the vote necessary for immediate effect, this
171171 Act takes effect September 1, 2009.
