55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eligible recipients of certain grants awarded by the
88 commissioner of education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.917, Education Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) This section does not authorize the commissioner to
1313 award a grant to an organization to provide a comprehensive
1414 educational program to students that serves as a substitute for a
1515 regular educational program provided by a school district or
1616 open-enrollment charter school. This section authorizes the
1717 commissioner to award a grant to an organization only for the
1818 provision of supplemental programs described by Subsection (a).
1919 SECTION 2. Section 39.361(c), Education Code, is amended to
2020 read as follows:
2121 (c) The commissioner of education or the commissioner of
2222 higher education, as applicable, shall consider the council's
2323 recommendations and based on those recommendations may award grants
2424 to school districts, open-enrollment charter schools, institutions
2525 of higher education, and regional education service centers[, and
2626 nonprofit organizations] to meet the goals of the council's
2727 strategic plan.
2828 SECTION 3. Subchapter L, Chapter 39, Education Code, is
2929 amended by adding Section 39.367 to read as follows:
3030 Sec. 39.367. CERTAIN GRANTS TO NONPROFIT ORGANIZATIONS NOT
3131 AUTHORIZED. This subchapter does not authorize the commissioner to
3232 award a grant to a nonprofit organization to provide a
3333 comprehensive educational program to students that serves as a
3434 substitute for a regular educational program provided by a school
3535 district or open-enrollment charter school.
3636 SECTION 4. It is the intent of the legislature that the
3737 grants that may not be awarded to an organization or nonprofit
3838 organization under Sections 29.917(d) and 39.367, Education Code,
3939 as added by this Act, include dropout recovery grants, such as the
4040 grants awarded in 2008 in response to the Texas Education Agency's
4141 Request for Applications (RFA) 701-08-116.
4242 SECTION 5. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2009.
