77 relating to reports on expenditures of hospital upper payment limit
88 supplemental payment program money.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0991 to read as follows:
1212 Sec. 531.0991. REPORTS ON UPPER PAYMENT LIMIT MONEY.
1313 (a) Not later than the first day of the second month following each
1414 calendar quarter, each hospital in the state that receives from the
1515 state federal money under the hospital upper payment limit
1616 supplemental payment program, other than money provided through the
1717 health opportunity pool trust fund established under Section
1818 531.503, shall submit a report to the commission that, for the
1919 previous calendar quarter, states the hospital's aggregated
2020 expenditures of that money that were health care related and the
2121 hospital's aggregated expenditures of that money that were
2222 non-health care related.
2323 (b) Not later than the first day of the second month
2424 following each calendar quarter, each private entity that
2525 administers a hospital upper payment limit supplemental payment
2626 program for a hospital or county or other governmental entity that
2727 receives money from this state under that program shall submit a
2828 report to the commission that, for the previous calendar quarter,
2929 states the administrative and legal fees charged by the private
3030 entity out of all upper payment limit money.
3131 (c) Not later than December 1 of each year, the commission
3232 shall provide to the standing committees of the senate and house of
3333 representatives having primary jurisdiction of health and human
3434 services a report that:
3535 (1) is based on the reports submitted by hospitals and
3636 private entities under Subsections (a) and (b) during the previous
3737 12-month period;
3838 (2) analyzes the percentage of federal upper payment
3939 limit supplemental payment program money paid to those hospitals
4040 that is used for health care related purposes and the percentage
4141 that is used for non-health care related purposes; and
4242 (3) analyzes the percentage of federal upper payment
4343 limit supplemental payment program money that is used for
4444 administrative and legal fees by those private entities.
4545 (d) The executive commissioner shall adopt rules as
4646 necessary that specify for purposes of this section the types of
4747 expenditures by hospitals that are health care related and the
4848 types of expenditures that are non-health care related.
4949 SECTION 2. Not later than February 1, 2010, each hospital
5050 and private entity to which Section 531.0991, Government Code, as
5151 added by this Act, applies shall submit the initial reports
5252 required by that section.
5353 SECTION 3. Not later than December 1, 2010, the Health and
5454 Human Services Commission shall submit the initial report required
5555 by Subsection (c), Section 531.0991, Government Code, as added by
5656 this Act.
5757 SECTION 4. This Act takes effect September 1, 2009.
