7 | 7 | | relating to reports on expenditures of hospital upper payment limit |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
---|
11 | 11 | | amended by adding Section 531.0991 to read as follows: |
---|
12 | 12 | | Sec. 531.0991. REPORTS ON UPPER PAYMENT LIMIT MONEY. |
---|
13 | 13 | | (a) Not later than the first day of the second month following each |
---|
14 | 14 | | calendar quarter, each hospital in the state that receives from the |
---|
15 | 15 | | state federal money under the hospital upper payment limit |
---|
16 | 16 | | supplemental payment program, other than money provided through the |
---|
17 | 17 | | health opportunity pool trust fund established under Section |
---|
18 | 18 | | 531.503, shall submit a report to the commission that, for the |
---|
19 | 19 | | previous calendar quarter, states the hospital's aggregated |
---|
20 | 20 | | expenditures of that money that were health care related and the |
---|
21 | 21 | | hospital's aggregated expenditures of that money that were |
---|
22 | 22 | | non-health care related. |
---|
23 | 23 | | (b) Not later than the first day of the second month |
---|
24 | 24 | | following each calendar quarter, each private entity that |
---|
25 | 25 | | administers a hospital upper payment limit supplemental payment |
---|
26 | 26 | | program for a hospital or county or other governmental entity that |
---|
27 | 27 | | receives money from this state under that program shall submit a |
---|
28 | 28 | | report to the commission that, for the previous calendar quarter, |
---|
29 | 29 | | states the administrative and legal fees charged by the private |
---|
30 | 30 | | entity out of all upper payment limit money. |
---|
31 | 31 | | (c) Not later than December 1 of each year, the commission |
---|
32 | 32 | | shall provide to the standing committees of the senate and house of |
---|
33 | 33 | | representatives having primary jurisdiction of health and human |
---|
34 | 34 | | services a report that: |
---|
35 | 35 | | (1) is based on the reports submitted by hospitals and |
---|
36 | 36 | | private entities under Subsections (a) and (b) during the previous |
---|
37 | 37 | | 12-month period; |
---|
38 | 38 | | (2) analyzes the percentage of federal upper payment |
---|
39 | 39 | | limit supplemental payment program money paid to those hospitals |
---|
40 | 40 | | that is used for health care related purposes and the percentage |
---|
41 | 41 | | that is used for non-health care related purposes; and |
---|
42 | 42 | | (3) analyzes the percentage of federal upper payment |
---|
43 | 43 | | limit supplemental payment program money that is used for |
---|
44 | 44 | | administrative and legal fees by those private entities. |
---|
45 | 45 | | (d) The executive commissioner shall adopt rules as |
---|
46 | 46 | | necessary that specify for purposes of this section the types of |
---|
47 | 47 | | expenditures by hospitals that are health care related and the |
---|
48 | 48 | | types of expenditures that are non-health care related. |
---|
49 | 49 | | SECTION 2. Not later than February 1, 2010, each hospital |
---|
50 | 50 | | and private entity to which Section 531.0991, Government Code, as |
---|
51 | 51 | | added by this Act, applies shall submit the initial reports |
---|
52 | 52 | | required by that section. |
---|
53 | 53 | | SECTION 3. Not later than December 1, 2010, the Health and |
---|
54 | 54 | | Human Services Commission shall submit the initial report required |
---|
55 | 55 | | by Subsection (c), Section 531.0991, Government Code, as added by |
---|
56 | 56 | | this Act. |
---|
57 | 57 | | SECTION 4. This Act takes effect September 1, 2009. |
