 A BILL TO BE ENTITLED
 AN ACT
 relating to certain responsibilities of a defendant serving a term
 of community supervision who changes residence within this state.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 17(a), Article 42.12, Code of Criminal
 Procedure, is amended to read as follows:
 (a) If, for good and sufficient reasons, a defendant desires
 to change the defendant's [his] residence within the state, the
 change may be effected by application to the defendant's
 [supervising] supervision officer. A[, which] change of residence
 under this subsection is [shall be] subject to the judge's consent
 and subject to any conditions of community supervision the judge
 imposes as a result of the change, in addition to any other
 conditions imposed under this article [such regulations as the
 judge may require in the absence of an officer in the locality to
 which the defendant is transferred].
 SECTION 2. Section 19, Article 42.12, Code of Criminal
 Procedure, is amended by adding Subsection (i) to read as follows:
 (i)  Notwithstanding Subsection (a), in a misdemeanor case
 in which the community supervision and corrections department
 supervising a defendant changes as a result of a change in the
 defendant's residence, the defendant shall pay any fee imposed on
 the defendant under this section to the department currently
 supervising the defendant.
 SECTION 3. This Act takes effect September 1, 2009.
