| 5 | 5 | | relating to the membership of the Advisory Board on Cosmetology. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Subsection (a), Section 1602.051, Occupations |
|---|
| 8 | 8 | | Code, is amended to read as follows: |
|---|
| 9 | 9 | | (a) The Advisory Board on Cosmetology consists of seven |
|---|
| 10 | 10 | | [five] members appointed by the presiding officer of the |
|---|
| 11 | 11 | | commission, with the commission's approval, as follows: |
|---|
| 12 | 12 | | (1) one member who holds a license for a beauty shop |
|---|
| 13 | 13 | | that is part of a chain of beauty shops; |
|---|
| 14 | 14 | | (2) one member who holds a license for a beauty shop |
|---|
| 15 | 15 | | that is not part of a chain of beauty shops; |
|---|
| 16 | 16 | | (3) one member who holds a private beauty culture |
|---|
| 17 | 17 | | school license; [and] |
|---|
| 18 | 18 | | (4) two members who each hold an operator license; |
|---|
| 19 | 19 | | (5) one member who represents a licensed public |
|---|
| 20 | 20 | | secondary or postsecondary beauty culture school or program; and |
|---|
| 21 | 21 | | (6) one public member. |
|---|
| 22 | 22 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 23 | 23 | | of this Act, the presiding officer of the Texas Commission of |
|---|
| 24 | 24 | | Licensing and Regulation shall appoint the additional members to |
|---|
| 25 | 25 | | the Advisory Board on Cosmetology as required by Section 1602.051, |
|---|
| 26 | 26 | | Occupations Code, as amended by this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2009. |
