55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the notice required of certain political subdivisions
88 concerning certain workers' compensation benefits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 504.053, Labor Code, is amended by
1111 adding Subsections (f) and (g) to read as follows:
1212 (f) If a political subdivision or pool provides medical
1313 benefits in a manner authorized under Subsection (b), the political
1414 subdivision or pool shall provide:
1515 (1) the notice an insurance carrier or employer is
1616 required to provide to employees under Section 1305.005, Insurance
1717 Code; and
1818 (2) any applicable information described by Section
1919 1305.451, Insurance Code.
2020 (g) An injured employee of a political subdivision or pool
2121 that provides medical benefits in a manner authorized under
2222 Subsection (b) shall be treated in the same manner as an injured
2323 employee is treated under Sections 1305.005(f) and (h), Insurance
2424 Code.
2525 SECTION 2. The change in law made by this Act applies only
2626 to a claim for workers' compensation benefits based on a
2727 compensable injury that occurs on or after the effective date of
2828 this Act. A claim based on a compensable injury that occurs before
2929 the effective date of this Act is governed by the law in effect on
3030 the date the compensable injury occurred, and the former law is
3131 continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2009.
