| 7 | 7 | | relating to the notice required of certain political subdivisions |

| 8 | 8 | | concerning certain workers' compensation benefits. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 504.053, Labor Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (f) and (g) to read as follows: |
|---|
| 12 | 12 | | (f) If a political subdivision or pool provides medical |
|---|
| 13 | 13 | | benefits in a manner authorized under Subsection (b), the political |
|---|
| 14 | 14 | | subdivision or pool shall provide: |
|---|
| 15 | 15 | | (1) the notice an insurance carrier or employer is |
|---|
| 16 | 16 | | required to provide to employees under Section 1305.005, Insurance |
|---|
| 17 | 17 | | Code; and |
|---|
| 18 | 18 | | (2) any applicable information described by Section |
|---|
| 19 | 19 | | 1305.451, Insurance Code. |
|---|
| 20 | 20 | | (g) An injured employee of a political subdivision or pool |
|---|
| 21 | 21 | | that provides medical benefits in a manner authorized under |
|---|
| 22 | 22 | | Subsection (b) shall be treated in the same manner as an injured |
|---|
| 23 | 23 | | employee is treated under Sections 1305.005(f) and (h), Insurance |
|---|
| 24 | 24 | | Code. |
|---|
| 25 | 25 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to a claim for workers' compensation benefits based on a |
|---|
| 27 | 27 | | compensable injury that occurs on or after the effective date of |
|---|
| 28 | 28 | | this Act. A claim based on a compensable injury that occurs before |
|---|
| 29 | 29 | | the effective date of this Act is governed by the law in effect on |
|---|
| 30 | 30 | | the date the compensable injury occurred, and the former law is |
|---|
| 31 | 31 | | continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2009. |
