55 relating to a prohibition against certain activities by a person
66 employed in the financial aid office of a public institution of

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1010 amended by adding Section 51.9645 to read as follows:
1111 Sec. 51.9645. PROHIBITION AGAINST CERTAIN ACTIVITIES BY
1212 FINANCIAL AID EMPLOYEES. (a) In this section:
1313 (1) "Institution of higher education" has the meaning
1414 assigned by Section 61.003.
1515 (2) "Student loan" means a loan for which the loan
1616 agreement requires that all or part of the loan proceeds be used to
1717 assist a person in attending an institution of higher education or
1818 other postsecondary institution.
1919 (3) "Student loan lender" means a person whose primary
2020 business is:
2121 (A) making, brokering, arranging, or accepting
2222 applications for student loans; or
2323 (B) a combination of activities described by
2424 Paragraph (A).
2525 (b) A person employed by an institution of higher education
2626 in the financial aid office of the institution may not:
2727 (1) own stock or hold another ownership interest in a
2828 student loan lender, other than through ownership of shares in a
2929 publicly traded mutual fund or similar investment vehicle in which
3030 the person does not exercise any discretion regarding the
3131 investment of the assets of the fund or other investment vehicle; or
3232 (2) solicit or accept any gift from a student loan
3333 lender.
3434 (c) A person who violates this section is subject to
3535 dismissal or other appropriate disciplinary action.
3636 SECTION 2. Subchapter F, Chapter 132, Education Code, is
3737 amended by adding Section 132.158 to read as follows:
3838 Sec. 132.158. PROHIBITION AGAINST CERTAIN ACTIVITIES BY
3939 FINANCIAL AID EMPLOYEES. (a) In this section:
4040 (1) "Student loan" means a loan for which the loan
4141 agreement requires that all or part of the loan proceeds be used to
4242 assist a person in attending an institution of higher education or
4343 other postsecondary institution, including a career school or
4444 college.
4545 (2) "Student loan lender" means a person whose primary
4646 business is:
4747 (A) making, brokering, arranging, or accepting
4848 applications for student loans; or
4949 (B) a combination of activities described by
5050 Paragraph (A).
5151 (b) A person employed by a career school or college in the
5252 financial aid office of the school or college may not:
5353 (1) own stock or hold another ownership interest in a
5454 student loan lender, other than through ownership of shares in a
5555 publicly traded mutual fund or similar investment vehicle in which
5656 the person does not exercise any discretion regarding the
5757 investment of the assets of the fund or other investment vehicle; or
5858 (2) solicit or accept any gift from a student loan
5959 lender.
6060 (c) A career school or college may not knowingly employ a
6161 person who violates Subsection (b). If a career school or college
6262 discovers that its employee is in violation of Subsection (b), the
6363 school or college shall promptly take appropriate action to cure
6464 the violation, including appropriate disciplinary action, based on
6565 the severity of the violation and whether the violation was
6666 inadvertent.
6767 SECTION 3. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2009.
