10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Chapter 61, Education Code, is amended by adding |
---|
12 | 12 | | Subchapter FF to read as follows: |
---|
13 | 13 | | SUBCHAPTER FF. PERFORMANCE INCENTIVE FUNDING |
---|
14 | 14 | | Sec. 61.9801. PERFORMANCE INCENTIVE FUNDING FOR CERTAIN |
---|
15 | 15 | | GENERAL ACADEMIC TEACHING INSTITUTIONS. (a) This section applies |
---|
16 | 16 | | only to general academic teaching institutions other than public |
---|
17 | 17 | | state colleges. |
---|
18 | 18 | | (b) In this section: |
---|
19 | 19 | | (1) "Advanced degree" means a graduate or professional |
---|
20 | 20 | | degree for which a baccalaureate degree is usually required as a |
---|
21 | 21 | | prerequisite to admission into the degree program. |
---|
22 | 22 | | (2) "At-risk student" means a student of an |
---|
23 | 23 | | institution to which this section applies: |
---|
24 | 24 | | (A) whose score on the Scholastic Assessment Test |
---|
25 | 25 | | (SAT) or the American College Test (ACT) is less than the national |
---|
26 | 26 | | mean score of students' scores on that test; |
---|
27 | 27 | | (B) who has been awarded a grant under the |
---|
28 | 28 | | federal Pell Grant program; |
---|
29 | 29 | | (C) who was 20 years of age or older on the date |
---|
30 | 30 | | the student initially enrolled in the institution; |
---|
31 | 31 | | (D) who initially enrolled in the institution for |
---|
32 | 32 | | less than 12 semester credit hours during a fall or spring semester; |
---|
33 | 33 | | (E) who did not receive a high school diploma but |
---|
34 | 34 | | received a high school equivalency certificate; |
---|
35 | 35 | | (F) who may not be claimed by any other person as |
---|
36 | 36 | | a dependent for federal income tax purposes but may claim at least |
---|
37 | 37 | | one other person as a dependent for federal income tax purposes; or |
---|
38 | 38 | | (G) who is a single parent. |
---|
39 | 39 | | (3) "Critical field" means a field of study designated |
---|
40 | 40 | | as a critical field under Subsection (c). |
---|
41 | 41 | | (c) Except as otherwise provided under Subdivision (2), the |
---|
42 | 42 | | fields of engineering, computer science, mathematics, physical |
---|
43 | 43 | | science, allied health, nursing, and teaching certification in the |
---|
44 | 44 | | field of science or mathematics are critical fields. Beginning |
---|
45 | 45 | | September 1, 2011, the board, based on the board's determination of |
---|
46 | 46 | | those fields of study in which the support and development of |
---|
47 | 47 | | postsecondary education programs at the bachelor's degree or |
---|
48 | 48 | | advanced degree level are most critically necessary for serving the |
---|
49 | 49 | | needs of this state, by rule may: |
---|
50 | 50 | | (1) designate as a critical field a field of study that |
---|
51 | 51 | | is not currently designated by this subsection or by the board as a |
---|
52 | 52 | | critical field; or |
---|
53 | 53 | | (2) remove a field of study from the list of fields |
---|
54 | 54 | | currently designated by this subsection or by the board as critical |
---|
55 | 55 | | fields. |
---|
56 | 56 | | (d) For each state fiscal year, the board shall distribute |
---|
57 | 57 | | any performance incentive funds appropriated by the legislature for |
---|
58 | 58 | | the purposes of this section, and any other funds made available for |
---|
59 | 59 | | the purposes of this section, to institutions to which this section |
---|
60 | 60 | | applies in proportion to the increase, if any, in the average number |
---|
61 | 61 | | of degrees awarded annually by each institution in the two most |
---|
62 | 62 | | recent fiscal years from the average number of degrees awarded |
---|
63 | 63 | | annually by that institution in the two fiscal years immediately |
---|
64 | 64 | | preceding those fiscal years, using the weights assigned to each |
---|
65 | 65 | | degree under the table prescribed by Subsection (e). |
---|
66 | 66 | | (e) A number of points is assigned for each degree awarded |
---|
67 | 67 | | by an eligible institution, other than a degree awarded to an |
---|

---|
82 | 82 | | institutions of higher education: |
---|
83 | 83 | | (1) public junior colleges; |
---|
84 | 84 | | (2) public technical institutes; and |
---|
85 | 85 | | (3) public state colleges. |
---|
86 | 86 | | (b) In this section: |
---|
87 | 87 | | (1) "At-risk student" means a student of an |
---|
88 | 88 | | institution to which this section applies: |
---|
89 | 89 | | (A) who graduated from high school with a |

128 | 128 | | described by Subsection (g) and degrees and certificates awarded |
---|
129 | 129 | | annually by that institution in the two fiscal years immediately |
---|
130 | 130 | | preceding those fiscal years, using the weights assigned to each |
---|
131 | 131 | | student transfer or degree or certificate under the table |
---|
132 | 132 | | prescribed by Subsection (h). |
---|
133 | 133 | | (e) Points may not be assigned under Subsection (h) for any |
---|
134 | 134 | | degree or certificate awarded: |
---|
135 | 135 | | (1) in a program on a topic or at a level that the board |
---|
136 | 136 | | determines does not merit funding under this section; or |
---|
137 | 137 | | (2) to an international student. |
---|
138 | 138 | | (f) Points may not be assigned under Subsection (h) for both |
---|
139 | 139 | | a student's certificate or degree and the student's transfer. |
---|
140 | 140 | | Points must be assigned for the student only in the category under |
---|
141 | 141 | | Subsection (h) in which the highest number of points will be |
---|
142 | 142 | | assigned for the student. |
---|
143 | 143 | | (g) Points may be assigned for a student transfer under |
---|
144 | 144 | | Subsection (h) only for a student of the institution who completed |
---|
145 | 145 | | at least 30 but not more than 70 semester credit hours at the |
---|
146 | 146 | | institution with a grade point average of at least 2.5 on a |
---|
147 | 147 | | four-point scale or the equivalent before transferring to a general |
---|

---|

242 | 242 | | at-risk student under Section 61.9801 or 61.9802. |
---|
243 | 243 | | (2) "Critical field" includes any field of study |
---|
244 | 244 | | designated as a critical field under Section 61.9801 or 61.9802. |
---|
245 | 245 | | (3) "End-of-degree examination" means an examination |
---|
246 | 246 | | approved by the board for purposes of this section as an effective |
---|
247 | 247 | | measure of the knowledge, skill, proficiency, and understanding |
---|
248 | 248 | | achieved by a student on completion of a degree program. |
---|
249 | 249 | | (4) "Licensing examination" means an examination |
---|
250 | 250 | | required for the issuance of a professional or occupational |
---|
251 | 251 | | license, except that in regard to an examination required for a |
---|
252 | 252 | | medical license, the term applies only to the first two sittings by |
---|
253 | 253 | | a student for any examination administered or accepted for that |
---|
254 | 254 | | purpose under Subtitle B, Title 3, Occupations Code. |
---|
255 | 255 | | (b) The board shall administer the Texas Academic |
---|
256 | 256 | | Excellence Award Program, under which the board annually: |
---|
257 | 257 | | (1) presents a Texas Academic Excellence Award to each |
---|
258 | 258 | | graduate of an institution of higher education whose licensing |
---|
259 | 259 | | examination score or end-of-degree examination score exceeds the |
---|
260 | 260 | | national average of students' scores on that examination or, if the |
---|
261 | 261 | | examination is not administered nationally, exceeds the statewide |
---|
262 | 262 | | average of students' scores on that examination; and |
---|
263 | 263 | | (2) provides funds to the institutions of higher |
---|
264 | 264 | | education from which the award recipients graduated in accordance |
---|
265 | 265 | | with Subsection (c). |
---|
266 | 266 | | (c) For each state fiscal year, the board shall distribute |
---|
267 | 267 | | any funds appropriated by the legislature for the purposes of this |
---|
268 | 268 | | subsection, and any other funds made available for purposes of this |
---|
269 | 269 | | subsection, to the institutions of higher education from which the |
---|
270 | 270 | | Texas Academic Excellence Award recipients for that year graduated, |
---|
271 | 271 | | in proportion to the number of degrees awarded by each institution |
---|
272 | 272 | | to students receiving the award for that year, weighted according |
---|
273 | 273 | | to the weights assigned to the degrees under the table prescribed by |
---|
274 | 274 | | Section 61.9801(e), 61.9802(h), or 61.9803(c), as applicable, |
---|
275 | 275 | | including any additional weights assigned to students who are |
---|
276 | 276 | | at-risk students or who graduated with a degree in a critical field. |
---|
277 | 277 | | (d) The board shall hire consultants to assist the board in |
---|
278 | 278 | | determining which end-of-degree examinations to approve for |
---|
279 | 279 | | purposes of this section. |
---|
280 | 280 | | Sec. 61.9805. RULES. The board shall adopt rules for the |
---|
281 | 281 | | administration of this subchapter. |
---|
282 | 282 | | Sec. 61.9806. REPORT BY INSTITUTIONS TO BOARD. Not later |
---|
283 | 283 | | than September 1 of each year, each institution of higher education |
---|
284 | 284 | | shall compile and submit to the board, in accordance with rules |
---|
285 | 285 | | adopted by the board, a report that includes the following data |
---|
286 | 286 | | regarding each student who was awarded a degree or certificate by |
---|
287 | 287 | | the institution, completed a medical residency with the |
---|
288 | 288 | | institution, or transferred from the institution to a general |
---|
289 | 289 | | academic teaching institution other than a public state college, |
---|
290 | 290 | | during the preceding state fiscal year: |
---|
291 | 291 | | (1) the student's scores on the Scholastic Assessment |
---|
292 | 292 | | Test (SAT) and American College Test (ACT); |
---|
293 | 293 | | (2) for a student who transferred from the institution |
---|
294 | 294 | | without completing a degree or certificate, the number of semester |
---|
295 | 295 | | credit hours completed by the student at the institution; |
---|
296 | 296 | | (3) the student's grade point average on all course |
---|
297 | 297 | | work completed at the institution; |
---|
298 | 298 | | (4) whether the student received a grant under the |
---|
299 | 299 | | federal Pell Grant program; |
---|
300 | 300 | | (5) the age of the student on the date the student |
---|
301 | 301 | | initially enrolled in the institution; |
---|
302 | 302 | | (6) whether the student initially enrolled in the |
---|
303 | 303 | | institution for less than 12 semester credit hours during a fall or |
---|
304 | 304 | | spring semester; |
---|
305 | 305 | | (7) whether the student is an international student; |
---|
306 | 306 | | (8) whether any degree or certificate awarded to the |
---|
307 | 307 | | student by the institution is in a field designated as a critical |
---|
308 | 308 | | field under Section 61.9801 or Section 61.9802; and |
---|
309 | 309 | | (9) any other information required by the board. |
---|
310 | 310 | | Sec. 61.9807. REPORT TO BOARD AND LEGISLATURE BY EDUCATION |
---|
311 | 311 | | RESEARCH CENTER REGARDING EVALUATION OF POINT ASSIGNMENTS. Each |
---|
312 | 312 | | state fiscal biennium, the board shall provide for the evaluation |
---|
313 | 313 | | by an education research center established under Section 1.005 of |
---|
314 | 314 | | the points assigned under Sections 61.9801, 61.9802, and 61.9803. |
---|
315 | 315 | | Not later than June 1 of each even-numbered year, the education |
---|
316 | 316 | | research center shall submit to the board and the legislature a |
---|
317 | 317 | | written report regarding the center's evaluation under this |
---|
318 | 318 | | section, including any recommendations for changes to the points |
---|
319 | 319 | | assigned under those sections. |
---|
320 | 320 | | SECTION 2. Section 61.0591, Education Code, is repealed. |
---|
321 | 321 | | SECTION 3. The Texas Higher Education Coordinating Board |
---|
322 | 322 | | shall adopt rules relating to the administration of Subchapter FF, |
---|
323 | 323 | | Chapter 61, Education Code, as added by this Act, as soon as |
---|
324 | 324 | | practicable after the effective date of this Act. |
---|
325 | 325 | | SECTION 4. Section 61.9804, Education Code, as added by |
---|
326 | 326 | | this Act, applies beginning with licensing examinations and |
---|
