1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 61, Education Code, is amended by adding
1212 Subchapter FF to read as follows:
1313 SUBCHAPTER FF. PERFORMANCE INCENTIVE FUNDING
1414 Sec. 61.9801. PERFORMANCE INCENTIVE FUNDING FOR CERTAIN
1515 GENERAL ACADEMIC TEACHING INSTITUTIONS. (a) This section applies
1616 only to general academic teaching institutions other than public
1717 state colleges.
1818 (b) In this section:
1919 (1) "Advanced degree" means a graduate or professional
2020 degree for which a baccalaureate degree is usually required as a
2121 prerequisite to admission into the degree program.
2222 (2) "At-risk student" means a student of an
2323 institution to which this section applies:
2424 (A) whose score on the Scholastic Assessment Test
2525 (SAT) or the American College Test (ACT) is less than the national
2626 mean score of students' scores on that test;
2727 (B) who has been awarded a grant under the
2828 federal Pell Grant program;
2929 (C) who was 20 years of age or older on the date
3030 the student initially enrolled in the institution;
3131 (D) who initially enrolled in the institution for
3232 less than 12 semester credit hours during a fall or spring semester;
3333 (E) who did not receive a high school diploma but
3434 received a high school equivalency certificate;
3535 (F) who may not be claimed by any other person as
3636 a dependent for federal income tax purposes but may claim at least
3737 one other person as a dependent for federal income tax purposes; or
3838 (G) who is a single parent.
3939 (3) "Critical field" means a field of study designated
4040 as a critical field under Subsection (c).
4141 (c) Except as otherwise provided under Subdivision (2), the
4242 fields of engineering, computer science, mathematics, physical
4343 science, allied health, nursing, and teaching certification in the
4444 field of science or mathematics are critical fields. Beginning
4545 September 1, 2011, the board, based on the board's determination of
4646 those fields of study in which the support and development of
4747 postsecondary education programs at the bachelor's degree or
4848 advanced degree level are most critically necessary for serving the
4949 needs of this state, by rule may:
5050 (1) designate as a critical field a field of study that
5151 is not currently designated by this subsection or by the board as a
5252 critical field; or
5353 (2) remove a field of study from the list of fields
5454 currently designated by this subsection or by the board as critical
5555 fields.
5656 (d) For each state fiscal year, the board shall distribute
5757 any performance incentive funds appropriated by the legislature for
5858 the purposes of this section, and any other funds made available for
5959 the purposes of this section, to institutions to which this section
6060 applies in proportion to the increase, if any, in the average number
6161 of degrees awarded annually by each institution in the two most
6262 recent fiscal years from the average number of degrees awarded
6363 annually by that institution in the two fiscal years immediately
6464 preceding those fiscal years, using the weights assigned to each
6565 degree under the table prescribed by Subsection (e).
6666 (e) A number of points is assigned for each degree awarded
6767 by an eligible institution, other than a degree awarded to an
6868 international student, according to the following table:

7979 Sec. 61.9802. PERFORMANCE INCENTIVE FUNDING FOR PUBLIC
8080 JUNIOR COLLEGES, PUBLIC TECHNICAL INSTITUTES, AND PUBLIC STATE
8181 COLLEGES. (a) This section applies only to the following
8282 institutions of higher education:
8383 (1) public junior colleges;
8484 (2) public technical institutes; and
8585 (3) public state colleges.
8686 (b) In this section:
8787 (1) "At-risk student" means a student of an
8888 institution to which this section applies:
8989 (A) who graduated from high school with a
9090 cumulative grade point average of less than 2.5 on a four-point
9191 scale or the equivalent;
9292 (B) who has been awarded a grant under the
9393 federal Pell Grant program;
9494 (C) who was 20 years of age or older on the date
9595 the student enrolled in the institution for the first time;
9696 (D) who initially enrolled in the institution for
9797 less than 12 semester credit hours during a fall or spring semester;
9898 (E) who did not receive a high school diploma but
9999 received a high school equivalency certificate;
100100 (F) who may not be claimed by any other person as
101101 a dependent for federal income tax purposes but may claim at least
102102 one other person as a dependent for federal income tax purposes; or
103103 (G) who is a single parent.
104104 (2) "Critical field" means a field of study designated
105105 as a critical field under Subsection (c).
106106 (c) Except as otherwise provided under Subdivision (2), the
107107 fields of engineering technology, computer science, mathematics,
108108 physical science, allied health, and nursing are critical fields.
109109 Beginning September 1, 2011, the board, based on the board's
110110 determination of those fields of study in which the support and
111111 development of postsecondary education programs at the
112112 lower-division level are most critically necessary for serving the
113113 needs of this state, by rule may:
114114 (1) designate as a critical field a field of study that
115115 is not currently designated by this subsection or by the board as a
116116 critical field; or
117117 (2) remove a field of study from the list of fields
118118 currently designated by this subsection or by the board as critical
119119 fields.
120120 (d) For each state fiscal year, the board shall distribute
121121 any performance incentive funds appropriated by the legislature for
122122 the purposes of this section, and any other funds made available for
123123 the purposes of this section, to institutions to which this section
124124 applies in proportion to the increase, if any, in the average number
125125 of student transfers described by Subsection (g) and degrees and
126126 certificates awarded annually by each institution in the two most
127127 recent fiscal years from the average number of student transfers
128128 described by Subsection (g) and degrees and certificates awarded
129129 annually by that institution in the two fiscal years immediately
130130 preceding those fiscal years, using the weights assigned to each
131131 student transfer or degree or certificate under the table
132132 prescribed by Subsection (h).
133133 (e) Points may not be assigned under Subsection (h) for any
134134 degree or certificate awarded:
135135 (1) in a program on a topic or at a level that the board
136136 determines does not merit funding under this section; or
137137 (2) to an international student.
138138 (f) Points may not be assigned under Subsection (h) for both
139139 a student's certificate or degree and the student's transfer.
140140 Points must be assigned for the student only in the category under
141141 Subsection (h) in which the highest number of points will be
142142 assigned for the student.
143143 (g) Points may be assigned for a student transfer under
144144 Subsection (h) only for a student of the institution who completed
145145 at least 30 but not more than 70 semester credit hours at the
146146 institution with a grade point average of at least 2.5 on a
147147 four-point scale or the equivalent before transferring to a general
148148 academic teaching institution other than a public state college.
149149 (h) A number of points is assigned for each degree awarded
150150 or student transfer by an eligible institution according to the
151151 following table:

204204 Sec. 61.9803. PERFORMANCE INCENTIVE FUNDING FOR MEDICAL AND
205205 DENTAL UNITS. (a) This section applies only to medical and dental
206206 units.
207207 (b) For each state fiscal year, the board shall distribute
208208 any performance incentive funds appropriated by the legislature for
209209 the purposes of this section, and any other funds made available for
210210 the purposes of this section, to institutions to which this section
211211 applies in proportion to the increase, if any, in the average number
212212 of degrees and certificates awarded by, and medical residencies
213213 completed at, each institution annually in the two most recent
214214 fiscal years from the average number of degrees and certificates
215215 awarded by, and medical residencies completed at, that institution
216216 annually in the two fiscal years immediately preceding those fiscal
217217 years, using the weights assigned to each degree, certificate, or
218218 medical residency completion under the table prescribed by
219219 Subsection (c).
220220 (c) A number of points is assigned for each degree or
221221 certificate awarded by, or medical residency completed at, an
222222 eligible institution, other than a degree or certificate awarded to
223223 or a medical residency completed by an international student,
224224 according to the following table:

239239 Sec. 61.9804. TEXAS ACADEMIC EXCELLENCE AWARD PROGRAM. (a)
240240 In this section:
241241 (1) "At-risk student" includes any student who is an
242242 at-risk student under Section 61.9801 or 61.9802.
243243 (2) "Critical field" includes any field of study
244244 designated as a critical field under Section 61.9801 or 61.9802.
245245 (3) "End-of-degree examination" means an examination
246246 approved by the board for purposes of this section as an effective
247247 measure of the knowledge, skill, proficiency, and understanding
248248 achieved by a student on completion of a degree program.
249249 (4) "Licensing examination" means an examination
250250 required for the issuance of a professional or occupational
251251 license, except that in regard to an examination required for a
252252 medical license, the term applies only to the first two sittings by
253253 a student for any examination administered or accepted for that
254254 purpose under Subtitle B, Title 3, Occupations Code.
255255 (b) The board shall administer the Texas Academic
256256 Excellence Award Program, under which the board annually:
257257 (1) presents a Texas Academic Excellence Award to each
258258 graduate of an institution of higher education whose licensing
259259 examination score or end-of-degree examination score exceeds the
260260 national average of students' scores on that examination or, if the
261261 examination is not administered nationally, exceeds the statewide
262262 average of students' scores on that examination; and
263263 (2) provides funds to the institutions of higher
264264 education from which the award recipients graduated in accordance
265265 with Subsection (c).
266266 (c) For each state fiscal year, the board shall distribute
267267 any funds appropriated by the legislature for the purposes of this
268268 subsection, and any other funds made available for purposes of this
269269 subsection, to the institutions of higher education from which the
270270 Texas Academic Excellence Award recipients for that year graduated,
271271 in proportion to the number of degrees awarded by each institution
272272 to students receiving the award for that year, weighted according
273273 to the weights assigned to the degrees under the table prescribed by
274274 Section 61.9801(e), 61.9802(h), or 61.9803(c), as applicable,
275275 including any additional weights assigned to students who are
276276 at-risk students or who graduated with a degree in a critical field.
277277 (d) The board shall hire consultants to assist the board in
278278 determining which end-of-degree examinations to approve for
279279 purposes of this section.
280280 Sec. 61.9805. RULES. The board shall adopt rules for the
281281 administration of this subchapter.
282282 Sec. 61.9806. REPORT BY INSTITUTIONS TO BOARD. Not later
283283 than September 1 of each year, each institution of higher education
284284 shall compile and submit to the board, in accordance with rules
285285 adopted by the board, a report that includes the following data
286286 regarding each student who was awarded a degree or certificate by
287287 the institution, completed a medical residency with the
288288 institution, or transferred from the institution to a general
289289 academic teaching institution other than a public state college,
290290 during the preceding state fiscal year:
291291 (1) the student's scores on the Scholastic Assessment
292292 Test (SAT) and American College Test (ACT);
293293 (2) for a student who transferred from the institution
294294 without completing a degree or certificate, the number of semester
295295 credit hours completed by the student at the institution;
296296 (3) the student's grade point average on all course
297297 work completed at the institution;
298298 (4) whether the student received a grant under the
299299 federal Pell Grant program;
300300 (5) the age of the student on the date the student
301301 initially enrolled in the institution;
302302 (6) whether the student initially enrolled in the
303303 institution for less than 12 semester credit hours during a fall or
304304 spring semester;
305305 (7) whether the student is an international student;
306306 (8) whether any degree or certificate awarded to the
307307 student by the institution is in a field designated as a critical
308308 field under Section 61.9801 or Section 61.9802; and
309309 (9) any other information required by the board.
310310 Sec. 61.9807. REPORT TO BOARD AND LEGISLATURE BY EDUCATION
311311 RESEARCH CENTER REGARDING EVALUATION OF POINT ASSIGNMENTS. Each
312312 state fiscal biennium, the board shall provide for the evaluation
313313 by an education research center established under Section 1.005 of
314314 the points assigned under Sections 61.9801, 61.9802, and 61.9803.
315315 Not later than June 1 of each even-numbered year, the education
316316 research center shall submit to the board and the legislature a
317317 written report regarding the center's evaluation under this
318318 section, including any recommendations for changes to the points
319319 assigned under those sections.
320320 SECTION 2. Section 61.0591, Education Code, is repealed.
321321 SECTION 3. The Texas Higher Education Coordinating Board
322322 shall adopt rules relating to the administration of Subchapter FF,
323323 Chapter 61, Education Code, as added by this Act, as soon as
324324 practicable after the effective date of this Act.
325325 SECTION 4. Section 61.9804, Education Code, as added by
326326 this Act, applies beginning with licensing examinations and
327327 end-of-degree examinations administered on or after September 1,
328328 2011.
329329 SECTION 5. This Act takes effect September 1, 2009.
