55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to disclosures on certain electronic communications that
88 support or oppose a candidate, public officer, or measure.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 251.001, Election Code, is amended by
1111 amending Subdivision (16) and adding Subdivision (21) to read as
1212 follows:
1313 (16) "Political advertising" means a communication
1414 supporting or opposing a candidate for nomination or election to a
1515 public office or office of a political party, a political party, a
1616 public officer, or a measure that:
1717 (A) in return for consideration, is published in
1818 a newspaper, magazine, or other periodical or is broadcast by radio
1919 or television; or
2020 (B) appears:
2121 (i) in a pamphlet, circular, flier,
2222 billboard or other sign, bumper sticker, or similar form of written
2323 communication; [or]
2424 (ii) on an Internet website; or
2525 (iii) in a blog.
2626 (21) "Blog" means an Internet website maintained by a
2727 person that contains regular entries of commentary, descriptions of
2828 events, or similar material.
2929 SECTION 2. Section 255.001(d), Election Code, is amended to
3030 read as follows:
3131 (d) This section does not apply to:
3232 (1) tickets or invitations to political fund-raising
3333 events;
3434 (2) campaign buttons, pins, hats, or similar campaign
3535 materials; [or]
3636 (3) circulars or flyers that cost in the aggregate
3737 less than $500 to publish and distribute; or
3838 (4) a blog maintained by:
3939 (A) an individual who does not receive
4040 compensation for maintaining the blog; or
4141 (B) a recognized news organization, including a
4242 newspaper, magazine, radio or television station or network, cable
4343 television operator, programmer, or producer, or Internet
4444 publication, that is not owned or affiliated with a candidate,
4545 political committee, or political party.
4646 SECTION 3. This Act takes effect September 1, 2009.
