77 relating to audio recordings of certain grievance proceedings or
88 meetings by school district employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.171, Education Code, is amended to
1111 read as follows:
1212 Sec. 11.171. SCHOOL DISTRICT GRIEVANCE POLICY. (a) A
1313 school district grievance policy must permit a school district
1414 employee to report a grievance against a supervisor that alleges
1515 the supervisor's violation of the law in the workplace or the
1616 supervisor's unlawful harassment of the employee to a supervisor
1717 other than the supervisor against whom the employee intends to
1818 report the grievance.
1919 (b) A school district grievance policy must permit a
2020 grievant to make an audio recording of any meeting or proceeding at
2121 which the substance of a grievance that complies with the policy is
2222 investigated or discussed, provided that the grievant gives three
2323 working days notice of the intention to make the audio recording to
2424 the person considering the grievance. The implementation of this
2525 subsection may not result in a delay of any timelines provided by
2626 the grievance policy and does not require the district to provide
2727 equipment for the grievant to make the recording.
2828 SECTION 2. This Act takes effect September 1, 2009.
