9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 11.171, Education Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 11.171. SCHOOL DISTRICT GRIEVANCE POLICY. (a) A | |
13 | 13 | school district grievance policy must permit a school district | |
14 | 14 | employee to report a grievance against a supervisor that alleges | |
15 | 15 | the supervisor's violation of the law in the workplace or the | |
16 | 16 | supervisor's unlawful harassment of the employee to a supervisor | |
17 | 17 | other than the supervisor against whom the employee intends to | |
18 | 18 | report the grievance. | |
19 | 19 | (b) A school district grievance policy must permit a | |
20 | 20 | grievant to make an audio recording of any meeting or proceeding at | |
21 | 21 | which the substance of a grievance that complies with the policy is | |
22 | 22 | investigated or discussed, provided that the grievant gives three | |
23 | 23 | working days notice of the intention to make the audio recording to | |
24 | 24 | the person considering the grievance. The implementation of this | |
25 | 25 | subsection may not result in a delay of any timelines provided by | |
26 | 26 | the grievance policy and does not require the district to provide | |
27 | 27 | equipment for the grievant to make the recording. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2009. |
