66 AN ACT
77 relating to establishment of the Texas Statewide Interoperability
88 Executive Advisory Council.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 421.095, Government Code, is amended by
1111 adding Subdivisions (3) and (4) to read as follows:
1212 (3) "Council" means the Texas Statewide
1313 Interoperability Executive Advisory Council.
1414 (4) "Interoperability" means the ability of public
1515 safety service and support providers, including providers of law
1616 enforcement, fire fighting services, emergency medical services,
1717 emergency management, public utilities, and transportation
1818 services, to communicate when necessary with staff from other
1919 responding agencies, and to exchange voice, video, and data
2020 communications on demand, in real time, and when authorized.
2121 SECTION 2. Subchapter F, Chapter 421, Government Code, is
2222 amended by adding Sections 421.0961 and 421.0962 to read as
2323 follows:
2424 Sec. 421.0961. TEXAS STATEWIDE INTEROPERABILITY EXECUTIVE
2525 ADVISORY COUNCIL. (a) The Texas Statewide Interoperability
2626 Executive Advisory Council is created as an advisory committee to
2727 the office of the governor to provide policy level direction and
2828 promote efficient and effective use of resources for matters
2929 related to public safety radio interoperability.
3030 (b) The council is composed of the following members
3131 appointed by the governor:
3232 (1) one representative from the Texas Department of
3333 Transportation;
3434 (2) one representative from the Sheriffs' Association
3535 of Texas;
3636 (3) one representative from the Texas Police Chiefs
3737 Association;
3838 (4) one representative from the Texas Fire Chiefs
3939 Association;
4040 (5) one representative from the Texas Municipal
4141 League;
4242 (6) one representative from the Texas Association of
4343 Counties;
4444 (7) two representatives from the governor's military
4545 staff or the state military forces;
4646 (8) one representative from the Texas Department of
4747 Criminal Justice;
4848 (9) one representative from the Department of Public
4949 Safety;
5050 (10) one representative from the Department of
5151 Agriculture;
5252 (11) one representative from the Parks and Wildlife
5353 Department;
5454 (12) one representative from the Health and Human
5555 Services Commission;
5656 (13) one representative from a federally recognized
5757 Indian tribe with tribal land in this state; and
5858 (14) two members of the public.
5959 (c) Members of the council serve two-year terms.
6060 (d) Members of the council serve without compensation.
6161 (e) The governor shall appoint a presiding officer of the
6262 council and the council shall elect other officers it considers
6363 necessary and appropriate. The presiding officer has authority and
6464 is responsible for the affairs of the council.
6565 (f) The council shall meet at least four times annually.
6666 (g) The council shall appoint subcommittees consistent with
6767 the needs of the council to address:
6868 (1) technical support and education issues regarding
6969 public safety wireless radio interoperable communications in this
7070 state;
7171 (2) federal, state, and local funding availability;
7272 and
7373 (3) outreach and liaison with federal and other state
7474 organizations working on public safety wireless radio
7575 interoperable communications solutions.
7676 (h) Chapter 2110 does not apply to the council.
7777 Sec. 421.0962. COUNCIL DUTIES. (a) The council shall assist
7878 the office of the governor in developing the strategic plan for
7979 radio interoperable communications for local and private entities.
8080 The council shall promote interagency cooperation and provide
8181 support statewide for efficient and effective use of local and
8282 private resources to achieve public safety wireless radio
8383 interoperable communications for local and private public safety
8484 agencies.
8585 (b) The council shall:
8686 (1) recommend guidelines and standards for operation
8787 for local and private public safety wireless radio interoperable
8888 communications systems in this state;
8989 (2) promote coordination and cooperation among local,
9090 state, federal, and tribal public safety agencies in addressing
9191 statewide public safety wireless radio interoperable
9292 communications needs in the state;
9393 (3) review priorities for statewide public safety
9494 wireless radio interoperable communications needs and assist users
9595 of the statewide system in the development of projects, plans,
9696 policies, standards, priorities, and guidelines for public safety
9797 wireless radio interoperable communications;
9898 (4) develop funding recommendations for short-term
9999 and long-term system maintenance;
100100 (5) research best practices of other states; and
101101 (6) provide recommendations to the governor and the
102102 legislature, when appropriate, concerning issues related to local
103103 and private statewide public safety wireless radio interoperable
104104 communications in accordance with homeland security presidential
105105 directives.
106106 SECTION 3. As soon as practicable after the effective date
107107 of this Act, the governor shall appoint members to the Texas
108108 Statewide Interoperability Executive Advisory Council created by
109109 this Act.
110110 SECTION 4. This Act takes effect September 1, 2009.
