66 AN ACT
77 relating to the right of a public school educator to remove a
88 student from the educator's classroom.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 21, Education Code, is
1111 amended by adding Section 21.0412 to read as follows:
1212 Sec. 21.0412. EDUCATOR'S RIGHT TO REMOVE STUDENT. (a) It
1313 is a violation of the educator's code of ethics adopted under
1414 Section 21.041 for an educator to retaliate against another
1515 educator for having removed a student from that educator's
1616 classroom as provided by Section 37.002.
1717 (b) Actions that may be considered retaliation under this
1818 section include:
1919 (1) suspending or terminating the employment of the
2020 educator; and
2121 (2) taking other adverse personnel action against the
2222 educator, including reassigning the educator or giving the educator
2323 a negative appraisal.
2424 (c) The board shall issue sanctions against an educator who
2525 violates this section. Sanctions may include:
2626 (1) issuing a reprimand;
2727 (2) placing a restriction on the certificate of the
2828 educator;
2929 (3) suspending the certificate of the educator; or
3030 (4) revoking or canceling the certificate of the
3131 educator.
3232 SECTION 2. This Act applies beginning with the 2009-2010
3333 school year.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2009.
