| 7 | 7 | | relating to the right of a public school educator to remove a |
|---|
| 8 | 8 | | student from the educator's classroom. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 21, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 21.0412 to read as follows: |
|---|
| 12 | 12 | | Sec. 21.0412. EDUCATOR'S RIGHT TO REMOVE STUDENT. (a) It |
|---|
| 13 | 13 | | is a violation of the educator's code of ethics adopted under |
|---|
| 14 | 14 | | Section 21.041 for an educator to retaliate against another |
|---|
| 15 | 15 | | educator for having removed a student from that educator's |
|---|
| 16 | 16 | | classroom as provided by Section 37.002. |
|---|
| 17 | 17 | | (b) Actions that may be considered retaliation under this |
|---|
| 18 | 18 | | section include: |
|---|
| 19 | 19 | | (1) suspending or terminating the employment of the |
|---|
| 20 | 20 | | educator; and |
|---|
| 21 | 21 | | (2) taking other adverse personnel action against the |
|---|
| 22 | 22 | | educator, including reassigning the educator or giving the educator |
|---|
| 23 | 23 | | a negative appraisal. |
|---|
| 24 | 24 | | (c) The board shall issue sanctions against an educator who |
|---|
| 25 | 25 | | violates this section. Sanctions may include: |
|---|
| 26 | 26 | | (1) issuing a reprimand; |
|---|
| 27 | 27 | | (2) placing a restriction on the certificate of the |
|---|
| 28 | 28 | | educator; |
|---|
| 29 | 29 | | (3) suspending the certificate of the educator; or |
|---|
| 30 | 30 | | (4) revoking or canceling the certificate of the |
|---|
| 31 | 31 | | educator. |
|---|
| 32 | 32 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2009. |
