66 AN ACT
77 relating to the evaluation of and funding for school district
88 programs for gifted and talented students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 29, Education Code, is
1111 amended by adding Section 29.124 to read as follows:
1212 Sec. 29.124. EVALUATION STANDARDS. (a) The commissioner
1313 shall adopt standards for the evaluation of programs for gifted and
1414 talented students.
1515 (b) A school district is not subject to the limitation under
1616 Section 42.156(c) if the district receives a satisfactory rating
1717 under the standards adopted under Subsection (a) and operates a
1818 program for gifted and talented students in accordance with:
1919 (1) the Texas Performance Standards Project; or
2020 (2) another program approved by the commissioner that
2121 meets the requirements of the state plan developed under Section
2222 29.123.
2323 (c) If a school district described by Subsection (b)
2424 subsequently fails to receive a satisfactory rating under the
2525 standards adopted under Subsection (a) for two consecutive school
2626 years, the district resumes being subject to the limitation under
2727 Section 42.156(c) until the school year following the school year
2828 in which the district receives a new satisfactory rating.
2929 SECTION 2. Section 42.156(c), Education Code, is amended to
3030 read as follows:
3131 (c) Except as provided by Section 29.124, not [Not] more
3232 than five percent of a district's students in average daily
3333 attendance are eligible for funding under this section.
3434 SECTION 3. Not later than January 1, 2010, the commissioner
3535 of education shall adopt standards required by Section 29.124,
3636 Education Code, as added by this Act.
3737 SECTION 4. This Act applies beginning with the 2010-2011
3838 school year.
3939 SECTION 5. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2009.
