| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 29, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 29.124 to read as follows: |
|---|
| 12 | 12 | | Sec. 29.124. EVALUATION STANDARDS. (a) The commissioner |
|---|
| 13 | 13 | | shall adopt standards for the evaluation of programs for gifted and |
|---|
| 14 | 14 | | talented students. |
|---|
| 15 | 15 | | (b) A school district is not subject to the limitation under |
|---|
| 16 | 16 | | Section 42.156(c) if the district receives a satisfactory rating |
|---|
| 17 | 17 | | under the standards adopted under Subsection (a) and operates a |
|---|
| 18 | 18 | | program for gifted and talented students in accordance with: |
|---|
| 19 | 19 | | (1) the Texas Performance Standards Project; or |
|---|
| 20 | 20 | | (2) another program approved by the commissioner that |
|---|
| 21 | 21 | | meets the requirements of the state plan developed under Section |
|---|
| 22 | 22 | | 29.123. |
|---|
| 23 | 23 | | (c) If a school district described by Subsection (b) |
|---|
| 24 | 24 | | subsequently fails to receive a satisfactory rating under the |
|---|
| 25 | 25 | | standards adopted under Subsection (a) for two consecutive school |
|---|
| 26 | 26 | | years, the district resumes being subject to the limitation under |
|---|
| 27 | 27 | | Section 42.156(c) until the school year following the school year |
|---|
| 28 | 28 | | in which the district receives a new satisfactory rating. |
|---|
| 29 | 29 | | SECTION 2. Section 42.156(c), Education Code, is amended to |
|---|
| 30 | 30 | | read as follows: |
|---|
| 31 | 31 | | (c) Except as provided by Section 29.124, not [Not] more |
|---|
| 32 | 32 | | than five percent of a district's students in average daily |
|---|
| 33 | 33 | | attendance are eligible for funding under this section. |
|---|
| 34 | 34 | | SECTION 3. Not later than January 1, 2010, the commissioner |
|---|
| 35 | 35 | | of education shall adopt standards required by Section 29.124, |
|---|
| 36 | 36 | | Education Code, as added by this Act. |
|---|
| 37 | 37 | | SECTION 4. This Act applies beginning with the 2010-2011 |
|---|
| 38 | 38 | | school year. |
|---|
| 39 | 39 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2009. |
