66 AN ACT
77 relating to the eligibility of certain nonprofit wildlife
88 conservation associations to conduct charitable raffles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2002.003, Occupations Code, is amended
1111 by adding Subsection (e) to read as follows:
1212 (e) A nonprofit wildlife conservation association and its
1313 local chapters are qualified nonprofit organizations under this
1414 chapter if the association or local chapter meets the eligibility
1515 criteria under this section other than the requirement prescribed
1616 by Subsection (a)(3), (b)(3), (b-1)(3), or (c)(3), as applicable.
1717 An association or local chapter that is eligible under this
1818 subsection may not use any proceeds from a raffle conducted under
1919 this chapter to attempt to influence legislation or participate or
2020 intervene in a political campaign on behalf of a candidate for
2121 public office in any manner, including by publishing or
2222 distributing statements or making a campaign contribution. A
2323 nonprofit wildlife conservation association may conduct two
2424 raffles each year and each local chapter may conduct two raffles
2525 each year under this chapter.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
