| 8 | 8 | | conservation associations to conduct charitable raffles. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2002.003, Occupations Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (e) to read as follows: |
|---|
| 12 | 12 | | (e) A nonprofit wildlife conservation association and its |
|---|
| 13 | 13 | | local chapters are qualified nonprofit organizations under this |
|---|
| 14 | 14 | | chapter if the association or local chapter meets the eligibility |
|---|
| 15 | 15 | | criteria under this section other than the requirement prescribed |
|---|
| 16 | 16 | | by Subsection (a)(3), (b)(3), (b-1)(3), or (c)(3), as applicable. |

| 17 | 17 | | An association or local chapter that is eligible under this |
|---|
| 18 | 18 | | subsection may not use any proceeds from a raffle conducted under |
|---|
| 19 | 19 | | this chapter to attempt to influence legislation or participate or |
|---|
| 20 | 20 | | intervene in a political campaign on behalf of a candidate for |
|---|
| 21 | 21 | | public office in any manner, including by publishing or |
|---|
| 22 | 22 | | distributing statements or making a campaign contribution. A |
|---|
| 23 | 23 | | nonprofit wildlife conservation association may conduct two |
|---|
| 24 | 24 | | raffles each year and each local chapter may conduct two raffles |
|---|
| 25 | 25 | | each year under this chapter. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2009. |
|---|
