8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 29.153, Education Code, is amended by | |
10 | 10 | amending Subsection (a) and adding Subsection (a-1) to read as | |
11 | 11 | follows: | |
12 | 12 | (a) In this section: | |
13 | 13 | (1) "Child" includes a stepchild. | |
14 | 14 | (2) "Parent" includes a stepparent. | |
15 | 15 | (a-1) A district shall offer prekindergarten classes if the | |
16 | 16 | district identifies 15 or more children who are eligible under | |
17 | 17 | Subsection (b) and are at least four years of age. A school | |
18 | 18 | district may offer prekindergarten classes if the district | |
19 | 19 | identifies 15 or more eligible children who are at least three years | |
20 | 20 | of age. A district may not charge tuition for a prekindergarten | |
21 | 21 | class offered under this section. | |
22 | 22 | SECTION 2. This Act applies beginning with the 2009-2010 | |
23 | 23 | school year. | |
24 | 24 | SECTION 3. This Act takes effect immediately if it receives | |
25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
28 | 28 | Act takes effect September 1, 2009. |
