55 AN ACT
66 relating to interoperable health information technology.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle I, Title 2, Health and Safety Code, is
99 amended by adding Chapter 183 to read as follows:
1010 CHAPTER 183. INTEROPERABLE HEALTH INFORMATION TECHNOLOGY.
1111 Sec. 183.001. The state shall leverage its market power to
1212 facilitate the adoption of health information technology the
1313 development of an statewide interoperable health information
1414 technology network The network must:
1515 (1) provide secure aggregation and access to health
1616 care data through the use of a federated health information
1717 exchange infrastructure.
1818 (2) provide cross-domain single sign-on allowing for
1919 real-time data aggregation across disparate organizations and
2020 systems; and
2121 (3) be compatible with recognized national data
2222 standards in order to allow for interstate interoperability.
2323 Sec. 183.002 DEFINITIONS. In this chapter:
2424 (1) "Health information technology" means the
2525 application of information processing, involving both computer
2626 hardware and software that deals with the storage, retrieval,
2727 sharing and use of health care information, data and knowledge for
2828 communication and decision-making, and includes:
2929 (A) An electronic health record that provides
3030 access in real-time to a patient's complete medical record;
3131 (B) a personal health record through which an
3232 individual, and anyone authorized by such individual, can maintain
3333 and manage such individual's health information;
3434 (C) computerized order entry technology that
3535 permits a health care provider to order diagnostic and treatment
3636 services, including prescription drugs electronically;
3737 (D) electronic alerts and reminders to health
3838 care providers to improve compliance with best practices, promote
3939 regular screenings and other preventive practices, and facilitate
4040 diagnoses and treatments;
4141 (E) error notification procedures that generate
4242 a warning if an order is entered that is likely to lead to a
4343 significant adverse outcome for a patient; and
4444 (F) tools to allow for the collection, analysis
4545 and reporting of data on adverse events, near misses, the quality
4646 and efficiency of care, patient satisfaction and other
4747 healthcare-related performance measures.
4848 (2) "Interoperability" means the ability of two or
4949 more systems or components to exchange information and to use the
5050 information that has been exchanged, including:
5151 (A) The capacity to physically connect to a
5252 secure network for the purpose of exchanging data with other users;
5353 (B) the ability of a connected user to
5454 demonstrate appropriate permissions to participate in the sharing
5555 of information over the network; and
5656 (C) the capacity of a connected user with such
5757 permissions to access, transmit, receive and exchange usable
5858 information with other users.
5959 (3) "Standard electronic format" means a format using
6060 open electronic standards that:
6161 (A) Enable health information technology to be
6262 used for the collection of clinically specific data;
6363 (B) promote the interoperability of health care
6464 information across health care settings, including reporting to
6565 local, state and federal agencies; and
6666 (C) facilitate clinical decision support.
6767 Section 183.003. PRIVACY AND SECURITY.
6868 The network is expected to adhere to all applicable state and
6969 federal privacy laws and to adopt appropriate security measures
7070 related to both to data within the network and the network itself.
7171 Section 183.004. GRANTS TO PROVIDERS.
7272 The state may establish and implement a program to provide grants to
7373 providers in need of assistance in obtaining hardware and software
7474 needed to access the network. The XXXX shall adopt rules to
7575 establish eligibility criteria, including financial need
7676 thresholds and allowable purchases under the grant program.
7777 Sec. 183.005. FUNDING. (a) The network may be funded
7878 through the General Appropriations Act and the state may request,
7979 accept, and use gifts and grants as necessary.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2009.
