| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subsection (a), Section 547.610, Transportation |
|---|
| 9 | 9 | | Code, is amended to read as follows: |
|---|
| 10 | 10 | | (a) Air-conditioning equipment: |
|---|
| 11 | 11 | | (1) shall be manufactured, installed, and maintained |
|---|
| 12 | 12 | | to ensure the safety of the vehicle occupants and the public; and |
|---|
| 13 | 13 | | (2) may not contain any refrigerant that is flammable |
|---|
| 14 | 14 | | or is toxic to persons unless the refrigerant is included in the |
|---|
| 15 | 15 | | list published by the United States Environmental Protection Agency |
|---|
| 16 | 16 | | as a safe alternative motor vehicle air conditioning substitute for |
|---|
| 17 | 17 | | chlorofluorocarbon-12, pursuant to 42 U.S.C. Section 7671k(c). |

| 18 | 18 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 19 | 19 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 20 | 20 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 21 | 21 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 22 | 22 | | Act takes effect September 1, 2009. |
