55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to creating the Texas Early Learning Council.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle B, Title 3, Human Resources Code, is
1010 amended by adding Chapter 71 to read as follows:
1111 CHAPTER 71. TEXAS EARLY LEARNING COUNCIL
1212 Sec. 71.001. TEXAS EARLY LEARNING COUNCIL. In this
1313 chapter:
1414 (1) "Board" means the board of the Texas Early
1515 Learning Council.
1616 (2) "Council" means the Texas Early Learning Council.
1717 Sec. 71.002. BOARD. (a) The board is composed of:
1818 (1) the administrative head of the following agencies
1919 or that person's designee:
2020 (A) the Texas Education Agency;
2121 (B) the Health and Human Services Commission;
2222 (C) the Department of Assistive and
2323 Rehabilitative Services;
2424 (D) the Texas Workforce Commission; and
2525 (E) the Department of Family and Protective
2626 Services;
2727 (2) a representative from the Health and Human
2828 Services Commission's nurse-family partnership program appointed
2929 by the executive commissioner of the Health and Human Services
3030 Commission;
3131 (3) a representative from the Health and Human
3232 Services Commission's women's health program appointed by the
3333 executive commissioner of the Health and Human Services Commission;
3434 (4) a representative from the early childhood
3535 intervention services program appointed by the commissioner of the
3636 Department of Assistive and Rehabilitative Services;
3737 (5) one member appointed by the lieutenant governor;
3838 (6) one member appointed by the speaker of the house of
3939 representatives; and
4040 (7) the following members appointed by the governor:
4141 (A) an employee of the governor's office;
4242 (B) an individual to represent federal
4343 children's programs and services; and
4444 (C) 11 members from the public and private
4545 sectors who have an interest in early childhood care and education,
4646 including representatives from the following fields:
4747 (i) early childhood education and
4848 development;
4949 (ii) child care;
5050 (iii) child advocacy;
5151 (iv) parenting support;
5252 (v) local community collaborations among
5353 early care and education programs and services;
5454 (vi) maternal and child health;
5555 (vii) children with special needs;
5656 (viii) business and industry;
5757 (ix) labor; and
5858 (x) law enforcement.
5959 (b) The governor shall request that the director of the
6060 regional office of the Administration for Children and Families of
6161 the United States Department of Health and Human Services provide
6262 the governor with a list of individuals, each of whom is eligible to
6363 serve as a representative appointed under Subsection (a)(7)(B).
6464 (c) In appointing the members of the council, the persons
6565 making appointments must attempt to reflect the geographic, racial,
6666 and cultural diversity of the state.
6767 Sec. 71.003. PRESIDING OFFICER. The governor shall
6868 designate a member of the board from the private sector to serve as
6969 co-presiding officer of the board with the member who is an employee
7070 of the governor's office.
7171 Sec. 71.004. TERMS. The members of the board appointed by
7272 the governor, the lieutenant governor, and the speaker of the house
7373 of representatives serve for staggered six-year terms, with the
7474 terms of one-third of the members expiring on February 1 of each
7575 even-numbered year.
7676 Sec. 71.005. COMPENSATION. The members of the board serve
7777 without compensation but are entitled to reimbursement for actual
7878 and necessary expenses incurred in the performance of official
7979 duties as provided by the General Appropriations Act.
8080 Sec. 71.006. POWERS AND DUTIES. The council shall:
8181 (1) coordinate existing state programs and services
8282 for children from birth to age three in order to better meet the
8383 early learning needs of children and their families;
8484 (2) implement the vision of a statewide, high-quality,
8585 accessible, and comprehensive early learning system to benefit all
8686 young children;
8787 (3) address how the state can:
8888 (A) expand access to high-quality early
8989 childhood development programs for all at-risk children under three
9090 years of age; and
9191 (B) improve the quality of services offered to
9292 very young children and their families;
9393 (4) inventory public and private early learning
9494 programs in the state and, if feasible, rate the effectiveness of
9595 each program;
9696 (5) work with pre-K and elementary school educators to
9797 establish a link between elementary schools and programs for
9898 children from birth to age three, and from age three to age five;
9999 and
100100 (6) link early learning programs to other early
101101 childhood providers, programs, and services, including specialized
102102 development and mental health services, pediatric and perinatal
103103 health services, and public benefit programs.
104104 Sec. 71.007. ANNUAL REPORT. Not later than December 1 of
105105 each year, the council shall report to the governor and legislature
106106 on the council's progress towards its goals and objectives.
107107 SECTION 2. This Act takes effect September 1, 2009.
