6 | 6 | | corporations for the development, retention, or expansion of |
---|
7 | 7 | | certain transportation facilities. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
9 | 9 | | SECTION 1. Section 501.101, Local Government Code, as |
---|
10 | 10 | | effective September 1, 2009, is amended to read as follows: |
---|
11 | 11 | | Sec. 501.101. PROJECTS RELATED TO CREATION OR RETENTION OF |
---|
12 | 12 | | PRIMARY JOBS. In this subtitle, "project" includes the land, |
---|
13 | 13 | | buildings, equipment, facilities, expenditures, targeted |
---|
14 | 14 | | infrastructure, and improvements that are: |
---|
15 | 15 | | (1) for the creation or retention of primary jobs; and |
---|
16 | 16 | | (2) found by the board of directors to be required or |
---|
17 | 17 | | suitable for the development, retention, or expansion of: |
---|
18 | 18 | | (A) manufacturing and industrial facilities; |
---|
19 | 19 | | (B) research and development facilities; |
---|
20 | 20 | | (C) military facilities, including closed or |
---|
21 | 21 | | realigned military bases; |
---|
22 | 22 | | (D) transportation facilities, including |
---|
23 | 23 | | airports, hangars, railports, rail switching facilities, [airport] |
---|
24 | 24 | | maintenance and repair facilities, [air] cargo facilities, related |
---|
25 | 25 | | infrastructure located on or adjacent to an airport or railport |
---|
26 | 26 | | facility, marine ports, inland ports, mass commuting facilities, |
---|
27 | 27 | | and parking facilities; |
---|
28 | 28 | | (E) sewage or solid waste disposal facilities; |
---|
29 | 29 | | (F) recycling facilities; |
---|
30 | 30 | | (G) air or water pollution control facilities; |
---|
31 | 31 | | (H) facilities for furnishing water to the |
---|
32 | 32 | | public; |
---|
33 | 33 | | (I) distribution centers; |
---|
34 | 34 | | (J) small warehouse facilities capable of |
---|
35 | 35 | | serving as decentralized storage and distribution centers; |
---|
36 | 36 | | (K) primary job training facilities for use by |
---|
37 | 37 | | institutions of higher education; or |
---|
38 | 38 | | (L) regional or national corporate headquarters |
---|
39 | 39 | | facilities. |
---|
40 | 40 | | SECTION 2. Section 505.1561, Local Government Code, as |
---|
41 | 41 | | effective September 1, 2009, is amended to read as follows: |
---|
42 | 42 | | Sec. 505.1561. PROJECTS RELATED TO AIRPORT FACILITIES IN |
---|
43 | 43 | | CERTAIN MUNICIPALITIES. For purposes of this chapter, "project" |
---|
44 | 44 | | includes land, buildings, equipment, facilities, and improvements |
---|
45 | 45 | | found by the board of directors to be required or suitable for the |
---|
46 | 46 | | development or expansion of airport or railport facilities, |
---|
47 | 47 | | including hangars, [airport] maintenance and repair facilities, |
---|
48 | 48 | | [air] cargo facilities, and related infrastructure located on or |
---|
49 | 49 | | adjacent to an airport or railport facility, if the project is |
---|
50 | 50 | | undertaken by a Type B corporation authorized to be created by a |
---|
51 | 51 | | municipality: |
---|
52 | 52 | | (1) that enters into a development agreement with an |
---|
53 | 53 | | entity in which the entity acquires a leasehold or other possessory |
---|
54 | 54 | | interest from the corporation and is authorized to sublease the |
---|
55 | 55 | | entity's interest for other projects authorized by Sections 505.151 |
---|
56 | 56 | | through 505.156; and |
---|
57 | 57 | | (2) the governing body of which has authorized the |
---|
58 | 58 | | development agreement by adopting a resolution at a meeting called |
---|
59 | 59 | | as authorized by law. |
---|
60 | 60 | | SECTION 3. (a) In accordance with Subsection (c), Section |
---|
61 | 61 | | 311.031, Government Code, which gives effect to a substantive |
---|
62 | 62 | | amendment enacted by the same legislature that codifies the amended |
---|
63 | 63 | | statute, the text of Sections 501.101 and 505.1561, Local |
---|
64 | 64 | | Government Code, as set out in this Act, give effect to changes made |
---|
65 | 65 | | by Chapter 1102 (H.B. 3440), Acts of the 80th Legislature, Regular |
---|
66 | 66 | | Session, 2007. |
---|
67 | 67 | | (b) To the extent of any conflict, this Act prevails over |
---|
68 | 68 | | another Act of the 81st Legislature, Regular Session, 2009, |
---|
69 | 69 | | relating to nonsubstantive additions to and corrections in enacted |
---|
70 | 70 | | codes. |
---|
71 | 71 | | SECTION 4. This Act takes effect September 1, 2009. |
---|
