BILL ANALYSIS S.B. 2058 By: Williams County Affairs Committee Report (Unamended) BACKGROUND AND PURPOSE A recent court decision held that the Harris County Road Law, enacted in 1913, does not prevail when in conflict with the general laws of the state. As proposed, this bill provides that the Harris County Road Law, an Act of the 33rd Legislature, Regular Session, 1913, prevails when not in conflict therewith, but in cases of such conflict, this Act and the rules and regulations adopted under this Act are required to control as to Harris County. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. ANALYSIS SECTION 1. Amends Section 33, Chapter 17, Special Laws, Acts of the 33rd Legislature, Regular Session, 1913, as follows: Sec. 33. Provides that the provisions of this Act are, and are required to be, held and construed to be cumulative of all General Laws of this State, on the subjects treated of in this Act, when not in conflict therewith, but in cases of such conflict, this Act and the rules and regulations adopted under this Act are required to control as to Harris county. EFFECTIVE DATE Effective date: upon passage or September 1, 2009.
