| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (a), Section 159.034, Local |
|---|
| 10 | 10 | | Government Code, is amended to read as follows: |
|---|
| 11 | 11 | | (a) The commissioners court may require the report to be |
|---|
| 12 | 12 | | filed with the clerk of the commissioners court, the county |
|---|
| 13 | 13 | | auditor, or any other county officer. However, the commissioners |
|---|
| 14 | 14 | | court may require the report to be filed with the county clerk or |
|---|
| 15 | 15 | | other elected county officer only if the county clerk or elected |
|---|
| 16 | 16 | | county officer consents to the imposition of that duty. [The |
|---|
| 17 | 17 | | commissioners court may contract with the secretary of state for |
|---|
| 18 | 18 | | the filing of reports under this subchapter.] |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2009. |
